Just got off the phone with them and was told that I could get a 475.00 set of axels to go on the trailer.. I told her that I wasnt going to pay for another set of axels cause the trailer should have been the right one to begin with...

I wouldn't pay either. If the deal was for a trailer that would work with the boat, they didn't give you what they offered.

Mercury will probably tell you that they no longer use model years to identify outboards, as that is there policy now. That model would be considered a 2009 due to the manufacturing date. See below..

Just got off the phone with Mercury.. They told me that the engine was boxed in 2008.. They did tell me that they no longer use model years to identify the engine.. But then they told me that the dealer should have told me that they engine was 2008 and a 2010.. He said that her not telling me that is wrong and that if they wanna call they would tell them that its a 2008 and not a 2010.. He said yes it was regesterd 2010 but it is still a 2008...

Okay, so at this point you know you have legitimate beefs with the dealer. What you have to do now is decide what you're going to do about it. You need to take a step back, do your best to factor out any emotions that may be clouding your judgment (easier said than done I know) and decide how to proceed. You need to determine exactly what you think they need to do to make you whole before communicating with them any more. Take your time and reason through it objectively taking into account what your expectations were for this rig and whether there's any way they can still be met, and if so, how. Once you've reached that conclusion talk to your attorney regarding the best way to convey it to the dealer, then get ready for the dance. But please, whatever you do don't use it any more until you've gotten some sort of resolution. Think of it in terms of an order that was mishandled at a restaurant. How likely are you to get any satisfaction if you've eaten half of it? I know this situation is not that simple, but you don't want to give these people any wiggle room.

I think if it was me I'd take the whole rig back and drop it off in their parking lot...while someone stands outside their lot on the road video-taping you doing that. Make sure the video has some way to reference the date. At this point I don't think I'd even consider giving them a chance to correct it. You got hosed on the motor...that's a $1500 poke you took at minimum. They got you a trailer that's not heavy enough for your boat. I wouldn't be very comfortable in thinking that they'll correct this mess.

I dont think that is going to do anything.. The boat has already been paid for and the registration has been done.. If they dont wanna take care of the problems then I will have no choice but to contact a lawyer...

Well I got the trailer issue settled.. They told me this morning that they are ordering another set of axles for it.. That should double the towing capacity1600 to 3200 lbs.. They didnt wanna do it but I come down hard on them about the engine year issue and the warranty issue.. I explaind that I felt like I was being run over and I had to draw then line somewhere.. I also told them that I talked to 2 other dealers and they told me that it was illegal for them to even sell me a trailer that wasnt rated for my boat.. The new set of axles will be here Monday..

what about the rest of the trailer? can it handle the weight?

i think the dealer is doing something for you but.........its still not right

Yes.. Even if I got another trailer it would be the same as this one.. The only difference would be dual axles.. I will go measure the frameing and post it..

Just went and measured and the trailer is made out of 2x4 square tudeing.. The loaner trailer that I had was for a tritoon and it was made from the same material...

Make sure that the manufacturer sends you a new sticker for it too. You want the weight tag to be correct if you ever get checked.

Thats a good point..

Thanks to everyone for all the advise on my problems.. I will post how it all works out after the new axles are installed..

The new tandem axel kit came in today.. I asked the dealer if I could just pick it up and install it myself.. I didnt wanna have to make 2 trips there cause it is 40 mile one way.. They said yes, if I felt comfortable doing it.. I told them that it would be no problem.. So I go pick it up and I have just finished installing it.. It made so much difference that it dont even seem like the same trailer.. My driveway is pretty ruff and could just barely get the boat in and out without the pontoons dragging.. (wabble side to side) Now it dont even come close.. I am so glad that this problem is solved..
