While checking out local news, now that I'm a Florida resident, I found an interesting article regarding a boat crash that happened this past Easter Sunday which left five people dead. Also included in the article is a very graphic report of the incident. Very tragic & interesting that no one is being charged even though drugs & alcohol are involved. However, civil charges have been filed.

Here's the link...

civil charges against the boat manufacturer  even after overloading the boat but they claim the boat design was dangerous. everyone on board including the driver had alcohol and drugs in there system but blame the boat. The driver was not over the limit but had .035 bac and article mentioned drugs in the systems of some passengers but dont say if the driver was on drugs.

Drugged up and drunk, you make your own bed now lie down in it. It's absurd that anyone would consider a case against the boat mfg. If we don't get some relief from these ambulance chasing lawyers were in big trouble.

I just read the whole report. My sympathies to the families, but that was a boat full of very stupid people.

if i am not mistaken the boat was rented for the trip. there were several others that were suppose to be on the boat also, that missed the trip. that would have put it even more overloaded. those were the lucky ones.

What I don't get is, most places in FL (that I have been too) have a navigation rule that require you to stay X amount of feet away from the shore (i.e. 100ft, 200ft, etc.).

They were operating running right next to the shore... which caused them to hit the dock that was sticking out further than the rest...

Even with the alcohol being under the limit (for the supposed operator), they still should face some sort of wreckless operation charge... its no different than a car running a red light and smashing into someone...

And yes, I agree... bowrider's have been around for quite some time... I can't believe they are trying to sue the boat builder for design... if thats the case, they would need to sue nearly every boat manufacturer out there, because 90% of them make some sort of BR model!

Just absurd!

My condolences to the family and surviving members, but they need to just own up, and realize it was their own stupidity that caused the accident in the first place!

Nah. One of the survivors owned the boat. See the "Title Fraud" part of the report. He was too drunk/drugged to drive, and somebody else was (supposedly) driving. One witness had him behind the wheel.....

I feel sorry for the families invovled but if your under the influence of any intoxicant you have no buisness operating anything whatso ever especially a boat. I believe that if anyone caught with an alcoholic beverage and or drugs on there boat in the water should be escorted to the dock and or launch and forced to trailer thier craft and sited for the simple fact that they are a danger to us all and our families .

In the Uniform Commercial Code, there is a statute against "business fraud". If I were crownline, I would charge the attorney and all he is representing with that.

The operator was twice legal limit in Booze, and had some pot in addition. They were going 25-35 MPH (depends on which witness) in a no wake zone. The operators vision was obscured by 4 persons seated in the bow. The boat was overloaded by having 14 in a boat certified for 12. According to the photos and evidence shown on the report, the boat was out of the channel. And the owner/operator was not charged?
Whats wrong with this picture?

They would not want me on that jury or in the courtroom.

In reading the report again , it appears the attorney represnting the "victims" was ON the boat and witnessed an intoxicated person operating the boat and the whole crash scene. And HE"S Suing the boat manufacturer?
No wonder that the American justice system is in shambles....
