Sounds like the OP has made his peace with the situation, but nobody should be relying on wikipedia for legal advice. Besides the fact that laws will very by state, wikipedia isn't always reliable. Best thing to do is to look at the ACTUAL LAW first. For Wisconsin, it is section 893.25 available here.

If things are not completely clear, the next step should be to talk to an attorney.

It certainly wasn't meant as legal advice, it was just breaking down in general what constitutes adverse possession.

Nobody should rely on a guy on a boat forum for legal advice either ;)

As far as boundary markers, I own a piece of rural property in Virginia which was passed to me through the family. The deed is pretty much as written generations ago. I haven't looked at it lately, but I remember one corner is marked by a "cucumber tree". Now who would know what a cucumber tree is or how long it lives?

Do a survey.

In some states if you give anyone permission to cross and use your land after a certain amount of time you can never stop them from crossing.

If you give them permission and they get hurt or they bring a friend with them and they get hurt you are sued because you said it was ok to be on your property.

If you have your land surveyed never put a fence or plant trees on the line.
If you do then the fence belongs to them too.

If they decide later to improve or repair the fence to suit them, you will have to pay for half of the repairs even if you did not ok them or want them.

Trees planted on or hanging over the property on to there side line can be trimmed back to the property line, and you may receive a bill for the labor.

If you put up a fence and want to be able to walk around the fence on both side you need to keep the fence back on your property the width you need to maybe used a 4 wheeler to inspect the fence and property and still be on your property and not there property.

If they sell there property to someone else then ... here you go again.

These are just a few things that have caused problems between neighbors in the past and will be in the future.

Also you may find out that he owns the land in question, and not you ! ! !

Get the survey. You had a really lousy real estate agent. A survey should have been done prior to closing. Then follow DianB's advice and discuss it with him over a beer.
