I was in nanaimo harbour, left the mother in law and the dog in the boat and went down to pick up some soda pops, Tony a guy working on the boat told me someone hit my boat!!
I approached this group of 4 ladies and thier sailboat, and politely said so, I hear we had a little accident...
They said ohh no! it was someone else, kept on denying it I said this guy here saw the whole thing, one of the ladies was really in my face, and went right up to the witness not sure why she did that, he saw the whole thing.
the mother in law, she was in the boat, said it was them too.
I asked for info, took some photos and got the witness name and number, went to the gas dock got the attendants number he saw the whole thing apparently the whole marina did it was quite a scene, then called rcmp. The ladies were having some guy repair their BBQ, the cops came back and told me they admitted hitting me
The thing that gets me is the way they were looking at me, like it was my fault!
never said sorry to us or thanks to the people that helped them, apparently they hit an old chris-craft before hitting me.:eek:
I have never been in this situation before any ideas on what I should do?
I called the charter company the boat belongs to and gave them the heads up.
They pushed my boat forward, always tie the line by crossing it over and it was really tight as I untied it, was told they really hit me hard and I believe it.

damaged my tilt davits, broke the tiller off and sheared the fuel line off my outboard tore the handle off the inflatable and broke the oar in half, I will post the damage photos later , just got home cant use the inflatable anymore....

here is a photo of the dingy on a good day:D.

WOW! Some people are just unbelievable! If you make a mistake at least do the right thing and own up to it. Not one of them did! How old were these ladies?

Sorry to hear about the damage to your boat. At least things can be replaced unlike people. Glad that eveyone, esp. your mother in law is ok. Still I am sure that it will be quite the headache to get fixed.

Hope everything turns out ok with the insurance and all!

Seems even yachting you can't avoid trashy people :rolleyes:

Sorry to hear about your mishap. I hope insurance doesn't give you too hard of a time.

keep track of the time you spend gettin gstuff priced and fixed, and your down time if your boat can't be used (how much would it cost per day to rent a replacement boat like yours?) and try to get them to pay that as well. Only because they were such butts about it. It's their insurance that's paying for it. You might not get it all but start high and settle in the middle.

My two cents. Given what you went through, their denial etc. I would discretely do everything in my power to have them arrested (they must have borken some law, failure to report, wreckless opertion etc). Talk to the local authorities, they will probably steer you away from this action, but find out if you can. Nothing like being hauled into jail on a misdemeanor warrant on a Saturday night to get your attention. This kind of stuff really gets under my skin....

I hope you got a police report from the officers!!!!

The nerve of some people... geez

I would absolutely file a claim against their insurance... should work just like an auto accident.

As indicated, document everything and try to get compensation... mostly for the principle of it!

If they don't have insurance, then your only option would be to sue.. if it comes to that, you have to decide of the headache, attorneys fees, time, etc. is going to be worth it.

haven't heard from them yet, called 2 times then went down there in person I tried. at the end of the day we went to file in small claims court, no lawyer needed and have witnesses, police were called (rcmp) because of the denial, they admitted they hit me to the cop and of course I took lots of photos.
I will serve the company tomorrow morning.

the owners of the charter company came down to my boat and said he would pay for damages, things worked out ok. Just wanted them to put it right.
I was going to hand in the small claims application this morning now I wont have to!

Charter Company is smart. Last thing they need is complaints and subsequent scrutiny that would highlight the fact that they basically hand inexperienced people big boats :eek:

Glad it is working out. I don't think I know four people that would stand together on a BS lie like that. Makes you wonder . . . :rolleyes:

I think I would have insisted on a sobriety test. sounds to me like they were beligerent and drunk. the nerve of people.

One thing I learned a long time ago. if you see a boat coming into a Marina area too fast with one person on the bow waving a boat hook run like crazy.
