I think you are probably fine. As someone said, you are merely storing an article which you sold but that remains in your possession. While it would be nice if all contingencies were in writing, it seems as though it was understood that the sublease on the marina slip only continued as long as he continued to pay for it. He failed to pay, so you removed the boat. You could have had it removed to dry storage at the marina then billed him for it, but instead you removed it to your own property and are storing it for free. That's a bonus for HIM. And frankly, the slip was in YOUR name, not HIS, so really you had no obligation to leave the boat there in my mind, and if you did, it'd be YOU that was responsible for things when the s*** hit the fan. So I think you did the right thing.

That being said.. you need to send him a LETTER by CERTIFIED MAIL RETURN RECEIPT REQUESTED and do it IMMEDIATELY. NOT an email, NOT a phone call, NOT a text message.. a real, signed letter. Keep a copy of said letter for your record. Take it to the post office to mail it, and get and keep the certified mail receipt. And if the return receipt arrives, keep that too. In the letter indicate in detail what happened - that because he failed to pay for the slip, the lease ended, and you have removed the boat. That to avoid HIS incurring fees at the marina, you have stored it at your own property free of charge. Put the address of where it is stored. Put your phone number and e-mail in the letter, and say that he can contact you to pick up the boat at any time.

If you want, you can indicate a time limit of some kind.

If you do this, I think you will be fine. A real letter is a good CYA device.

As an "attorney", i'm surprised you didn't take the time to read the last 10 or so posts before yours. If you had, you'd see that your post wasn't even needed.

Then again....my wife works for an attorney and she does all his reading for him. He's helpless. :)

You're all missing one main piece of the puzzle... The buyer never took possession of the boat. He paid for it, but never took possession. Until he takes possession, the original owner is entrusted to do what is deemed "The right thing" to ensure that the property is taken care of. If he didn't, he could be sued for failure to ensure confident transfer... or something like that. Yes, Country_bumpkin could have charged/sued for more money for the extra time and storage in his driveway, but he didn't.

On the other hand, you have to put yourself in the buyers shoes... would you not want C.B. to take the boat out of the slip for you? If it were me, I would have thanked him profusely for this added service, and apologized to him for being so late taking possession.

I realize the buyer already got his boat, but I did want to comment on this. Once the paperwork is signed over him he takes possession of the boat not matter where it is. Just because my car is in someone else's driveway when I am visiting them it does not mean it it his just because it is in his driveway. All my bill of sales include the phrase "as is where is" Once the paperwork is signed it is his.

The danger of not reading all the posts in a thread I suppose :). Oh well, perhaps the advice will be helpful should anyone else find themselves in this predicament. :eek:

So let's see here . . . Your Wife does all the Attorney's reading for him . . . Yet he's probably taking down well over 6 figures a year, so he may be helpless but it appears he's no dummy :D

I agree with a couple of the posts above. Tell him you SAVED him money, as the marina was going to start charging $xxx per month to keep it there past the deadline. Also tell him that the marina can put a lien against a boat if it is past due, and it won't leave the marina until that lien is paid off. (yes, technically that wouldn't have happened here since they had a direct line to your account, but in other situations that very well could have happened.)
