Re: sold a boat and it busted!

congrats cb.

Although it is a bit of a hollow victory in that we won't know if the judge would have told the whiners errr plaintif to go suck egg.

As in to confirm as-is, no-warranty still means what we all think it means, etc.

GREAT News! Nice work Country Bumpkin! Looks like you've handled this as best one could. Saved yourself the $ and hassle of going to their court, AND set yourself up for another victory in your County if it comes to that.

Hopefully this is the last you'll see or hear from the "buyers".

Congrats CB ... glad it is working out for you.

Good reminder for all of us - "As Is" really should mean "As-Is" unless it can be proven fraud was involved.

Thats great Country B,
As big of a Bit** as mom was it won't surprise me if they come to Knox county and try again. Either way they are fighting something they won't win.
I hope they leave you alone so you can enjoy the rest of the summer.

Hopefully they won't refile in your county. Hopefully it didn't cost you too much to have your attorney go there and represent you -- or was it done by mail? Still, I hope you didn't have to pay too much.

Was all done by mail. The attorney was an aquiantance, and I do want to pay for his time and fedex fees. I have a feeling that he really didn't spend more than an hour or two on it. Even if it ends up costing me a grand (I expect around 500 though), it was worth it.

Ya know scaaty..that is not a bad idea at all...anyone here a lawer or know/related to one? A good state generic contract/bill of sale JUST for watercraft....nice idea. Georgia has one but it is not that good and wont cover you...

Congrats on this C B!! Ultimately you will win because they will find the cost of doing business remotely too steep and it will be too daunting working on your lawyers home turf. Treat your lawyer friend well, he is worth his weight in gold.

This thread was better than any TV show out there! I have been gone for two weeks and couldn't wait to get on here to find out the results.

Glad it worked out for you CB, it's just too bad you had to go threw any of this BS in the first place. I'd say counter sue them for your attorney's fees but that may mean they will come to your county and possibly file a petition there...

As someone else noted, "Good on ya."

Re: sold a boat and it busted!

I bought a boat my first boat this summer for $500, a little 14' fibreglass with a 20hp johnson, including trailer - he advertised it ready to launch. I took the boat home and quickly realized that the motor needed some serious work, new rings, impeller, carb job, and possibly rings. But the fact is - I still got a steal of a deal - I borrowed my uncles outboard for the summer when he wasn't using it - trailer holds up great, boat doesn't leak a drop and I have a project for the winter.

The kid shouldn't have gotten himself in so deep. Start off small and work your way up... Geez - you know its bad when your mom is calling... I feel bad for the kid but considering he is probobly still living at home - he will just have to chop this up as a life lesson. Its not cheap to own a boat - simply put

The boat worked great for his test run and he took the boat after the test run and on the bill of sale u had no warranty and being sold as is.This guy doing full forward throttle to full reverse throttle. As long as u know the boat was working perfect prior to it leaving your possesion i wouldn't worry about it.

My attorney said you can't do this, or at least that's what I understood him to say. Anyway his bill was 500 bucks. Right at what I was considering to give the kid at the very begining of this whole ordeal, until they started threatening this suit.

Cost me the same either way. They're out the 500 now.
