i tell you, i'm at a point that would lead me to drastic measures over the deal you're experiencing.<br /><br />but i would not, can not, should not do it, due to my station in life with wife & little girl. believe me though, if not for them, i'd drive up there and jump on that situation. i would have nothing to do with tree huggers, snaildarter smoochers, etc, but i feel kinship with the buds here, and would fight for them... i'm stupid eh?<br /><br />i hate it that we're losing land so fast. i guess we should hope for irrigation & oxygen on mars... ;)

Do some research and represent yourself if you dont want to front the retainer. With a little looking you should be able to determine what the legality of the situation is. The fact the work has already started should not deter you there have been structures razed for lesser violations of codes than this. also follow up with pertinant departments listed above because this is way over towns jurisdiction, when messing with water there has to be a federal agency in ther somwhere with jurisdiction.

To all who responded,<br /><br />I greatly appreciate all the suggestions.<br /><br />I have been battling with the Town on this issue and continue to get the run around.<br /><br />The Town has announced that it is going to hold a hearing on this matter next week, but the public IS NOT INVITED , and is a CLOSED DOOR MEETING between the Town and the contractor.<br /><br />This has been happening for the past year!<br /><br />The Town does not want public opinion on this matter. (That is why we have figured that this contractor has paid-off the Town, which is a normal occurance here. Basically, if you have the money to pay the Town, you can get away with anything you want, legal or not.)<br /><br />The County and State have both said that this is a Town issue and not their jurisdiction.<br /><br />I feel that the only way to get the attention of the Town, County and State are to try to contact the news media, such as "Problem Solvers", but I have the feeling that we have spent to much time trying to deal with the Town and that it may be too late.<br /><br />But, I'm still going to try.<br /><br />Once again, thank you all for your input, it's been helpful.<br /><br />Kenny

hey Ken,<br />$10K for a mouthpiece??? r u kidding?<br />am sure you could get a paraleagal to help YOU <br />file suit for less the $200 total.<br />have any niehbors had water damage as a result?<br />without damages, no "civil" suit really. then<br />suit would have to be filed by state for breaking<br />laws concerning watersheds. go over the towns<br />head to the state IMHO. have you tried the DEC yet?<br />those guys on the board are not paid by state, they<br />volunteer their time. also, is this a "drainage<br />ditch" or a year round stream? that makes a BIG diff.<br />good luck,<br />M.Y.

Good News,<br /><br />I just recieved an E-Mail from the Army Corp. of Engineers and they claim that they are sending an enforcement officer to the 2 sites that I have mentioned today!<br /><br />We shall see what happens.

Hi mellow,<br /><br />You are lucky you do not live in NY.<br /><br />Lawyers here are soooo greedy, they did not even want to look at the problem without a binder.<br /><br />10K was the cheapest lawyer we could find that was willing to even consider this case, most wanted 12K - 25K!!<br /><br />Its amazing anything gets done around here!

contact some local colleges that teach law.<br />profeesor and students might use as a case<br />study and do it for free...

My mother in law just got a letter stating that the township she lives in is trying to pass a ordinance that says if you have a dwelling less then 100 ft from a lake river or stream it has to be moved they snuck it by once and the relaters stopped it so that how the laws are here I wish I could help ya your getting lots of great advise though but I would follow through with it best of luck

Dum dee dum dum! :D <br /><br />Kenny now that you have the COE involved you should get results. It probably will take time, but you got the wheels turning. At least now the authorities can have a look see. Good job! :)

I have been reading this post and here is what happened to me yesterday. I appied for a permit to expand my boat house at the cottage. All the permits were issued by local govt The project is about 1/3 done but the provincial ministry of the environment came to see and promptly shut it down. The reason My existing boat house is grandfathered in and thats fine but I can't build a new one at the current location. So Ken the fact that local govt says its ok doesnt mean it can happen as in my case so I would presure all the fed agencys that deal with environment and push real hard

miloman...thats the way things are here, every few years they increase the setbacks and the ones that have been grandfathered can only be remodeled not expanded or rebuilt must stay with existing shell. Makes for some interesting remodel projects.

Hi all,<br /><br />Thanks for all the responses from all of you, they have been helpful.<br /><br />To date, the only thing that has happened is that a stop work order was issued.<br /><br />At this time, I do not know who issued it, but the contractor just tore down the signs and is continuing construction. (They poured the footings for the third house yesterday.)<br /><br />There is suppose to be a Closed Door Town Meeting tommorrow, but I am pretty sure the Town is going to side with the contractor. (This contractor is infamous for paying off the Town to get what he wants!)<br /><br />I have not recieved anything from the Army Corps. of Engineers yet, though they claimed they were going to send someone out in the field to have a look.<br /><br />That is all the info I have at this time, but I will let you guy's know.

A video with the date and time of the site wouldn't hurt. Locally, we have T.V. reporters that go out and look for stuff like this to expose wrong doers. Anybody like that in your neck of the woods?

(Already pay over 10,000/year.)<br /><br />The latest word from the Closed Door Meeting is that the Town has come up with a resolution, but it is not for publication.<br /><br />Basically, they have given the contractor a free hand in dealing with this property any way he seems fit!<br /><br />The new footings for the 3rd home is only 12ft. from my property line, even though the Town ordinance is a minimum of 25ft, but the Town said its OK, even though I have not signed a variance that would otherwise be necessary.<br /><br />So far it looks like I'm screwed, all in the name of profits for the contractor and the Town.<br /><br />Around here, money talks, and the taxpayer has to take it up the yahoo!<br /><br />Still no reply from the Army Corps. of Engineers.<br /><br />Oh, by the way, the other 2 homes next to me have been sold, 1 for $725,000, the other for $785,000.<br /><br />Contractor paid only $325,000 for the whole 4 acre lot, and these 3 lots are .75 acre, even though the Town Building Code requires a minimum of 1 acre.<br /><br />The remaining 1.75 acres has an existing dwelling and the property cannot be subdivisioned, due to the location of said dwelling.

10,000 a year in tax's on a home on 1 acre!!! No wonder they want to let them build more homes. Thats really a lot of money in tax's. :eek:

Yes it is Flaht, want to trade tax bills? LoL<br /><br />Now I hear they are going to ask for a 6% tax hike soon.<br /><br />Don't know how I'm goin to pay it, but I'll figure out something.
