Not sure what its like down in your neck of the woods but here in Canada we have a law that says that any body of water has to have public access. It basically means that this law is void before it gets written by a higher law. Lake Ontario is a public body of water and there fore access to it cannot be restricted under Fisheries and Oceans Act. The only exemption is for reservoirs for drinking water or for such thingsas Tailings ponds for mines and such. I doubt very much if Lake Ontario could be considered a reservior.

In Canada, if I wanted to I could walk across their lawn to set up my grill "on their beach". The home owners would have no say.

Not sure if US has a similar Act in place.

I would disagree with that. I own the beach. My deed says to the waters edge. You can not park your butt on my beach and have a BBQ.

Also the City of Welland where I live has banned the use of motor boats in the old canal. Only row boats and canoes etc are permitted. It used to be a very popular spot to water ski and jetski until they banned them. We even had a water ski club that got kicked out.

I was always under the impression that owning lake front property in Canada meant that the owner was entitled to all the land to the high water mark and as well puplic accsess to the lake would be available "X" amount of meters/yards along the lake shore.

Re: Town debates exclusion zone for boats on Lake Ontario shore

I've been following this development on a facebook group which I joined for boating purposes. The page has become a center of discussion for those on the "boater rights" side of things. Lots of animosity it seems between boaters, home owners and a neighborhood bar on the beach which has been around for 60 years or so.

The beach never used to be there before the pier was built in the mid 80's by the army corp of Engineers. Satellite photos over the years show how the shore line has changed and home owners inadvertently wound up with a huge beach.

There is a strip of beach which is public alone the pier. Great little spot. Local surfers hang there and catch waves. It has always been one of the places people go to relax on or near the water.

The rest of the beach is private but the bar used to allow boaters to access the bar beach from the water. They stopped doing this last year or the year before when this started to heat up I think.

It's a triangle between, boaters, home owners and the bar. It's heating up and the boating season is on the door step this season. It will be interesting to see how this plays out and what resolution comes out of it.

I think it will be very hard to set a 450 limit the water and even harder to enforce it. Who's jurisdiction does this fall under? Sheriff boats? DEC? Coast guard? I grew up in the town and I don't think local PD even have a boat. It will be interesting to see what happens the first sunny day if this law passes. Will all 40 boats who are tied up together get violations?

If the 450 limit passes with the exception of homeowners being allowed to keep their boats there then WATCH OUT! It's going to make some people VERY, VERY upset.

Glad this beach isn't one of my preferred anchor spots!

I thought I'd share this with fellow boaters whether you're from NY or not:
http://www.democratandchronicle.com/article/20120417/NEWS01/304170065/irondequoit-boating-regulation-culver-road?odyssey=tab|topnews|text|Home

The town of Irondequoit is proposing a regulation that "boats cannot be anchored, moored, adrift or joined together with any other vessel within 450 feet of the area of the Lake Ontario shoreline running west from the Irondequoit Bay Outlet Pier to the east property boundary of 186 Lake Bluff Road." They claim there have been a number of boaters tie off too close to shore of the property owners. Some complain about noise, garbage, and boaters dragging their grills onto their beaches.

This seems a little ridiculous and not like the behavior of most boaters. The town has the right to create a zone, but if its a safety issue and in the best interest of town. I guess they see a bunch of anchored boats with their engines turned OFF a hazard.

An update, the law got passed: http://www.whec.com/news/stories/s2631435.shtml?cat=565

The 450ft rule was changed to 300ft and land owners don't get an exception to the rule.

This is an interested topic. I can't say I am one way or the other. I am a boater, though I anchor at the sand bar in the bay, which isn't bugging anyone. I am 30 and I was amazed how many kids where using mom and dad's boat to drink and hang out. Then I looked closer and realized they were 15 years older than me, but were acting like annoying drunken kids. I like the idiot who was reving his engine, while it was in the trailer trim position w/ people on his sun platform. ><

the law is only passed till someone fights it.....

we have had a simelar law put in place by the city....lol.....

they towed some guys house boat to the shore....loaded it and put it in storage....they didnt winterise it...or do any preventive maintenence...

the owner was away in phoenix......lol....

he is fighting the law.....and he is going to win.....iin canada.....the queen owns the water....and any other law around it gets shot down....
the city is going to have to buy this guy a new boat. lol

the first time someone gets cited for this "new law" and decides to fight it...... the town is in for a world of hurt !

They really should increase the taxes for houses on the beach to pay for the enforcement. I bet this will make the bay really congested and almost dangerous. On the other hand they are very close to shore.

That last picture looks a bit crowded. Lol

We anchor and hang out in a cove, by ourselves usually, one cove down from a popular tie-up spot on our favorite lake. I am amazed at the behavior of the idiots that tie-up together here. They throw trash over board, play music load enough to hear it for miles, swim to shore to use it as a restroom. A perfect example of how a few will ruin something for the rest of us. I know it will only be a matter of time until they pass laws around here on "tie ups" Pretty sad!
