You have circled the wagons on this one. Obviously from your e-mails he doesn't want to go to court. Verdict depend on how you present and the judge. Forget the criteria, I have had the easy ones go south and more complicated prevail.

What he offered on the first pass is a good start. Here is what I would highly advise.

1. Use the info everyone has offered to you to find out what it would accurately cost you. Get it in writing. If it exceeds 5k, sue for 5k but show the overage.

2. Don't be emotional. This is not a lemon law case.

3. Go spend the 100 bucks and file.

4. Put together a "play book" as to how you will present your side. Now as you read this, pause and put in what he will say in return and mark it so you are organized. Have phto's, invoices, the add, everything ready to give to the judge.

5. You have a really good shot at recovering damages. Remember, you never know what the judge will do. And do not mention doing any work yourself.

BRAND NEW GM performance 350 from Summit racing less than $1600 shipped. I have one and it's awesome.

time for court....if the seller knew about the trouble. .the add is fraud

if you loose

in this case i would get a doner boat.

his mechanics can supply the labor.

sorry guys,
i was a little bitchy last night
i was gettin my game plan organized for court.

productive day so far
seller called and made me an offer of 1700 to keep him outa court
i accepted. regretably, however, it is enough to adress the additional issues i have uncovered

also preferred shop called me back
great that my second opinion is my first choice
also shop does all the machine work in house and has the facilities to do so,
its looking like i will use him to properly rebuild engine top to bottom.
starting off again with a full survey of all the issues.
summit racing new gm block does look tempting though

first shop labor to dig in and assess the situation around 700.
will be picken it up within the next few days

anyone on here against the rebuild?
shop will measure out everything to make sure the block is worthy and within allowable specs.

what do you guys think?

Exhaust manifolds and risers, they are often the cause of the issues this motor is having. so check em or just change em.

first shop said flappers were gone,
ill find out for sure if they actually looked into them or just figured overheat ate em up.

help me out a little,
do you suspect them being plugged up?
could that be the cause of the engine temp dropping verry quickly (1 min) after shutting down?
quick heat and quick cool i suspected no water on temperature sender
help me understand

update,
seller gave 1700 to stay outa court!
looks like i am going on with the project.

i did research tulip valves (overheat for sure)
makes me wonder if the heads were ever pulled in the first place at the rebuild
i guess its possible to do a rebuild with a thermostat and thermostat gasket(if that was all that was wrong, it would constitute a rebuild)lol
its all in the verbage i guess.

allright i am done,no more bitchen

Wow...stories like this are what made me forget buying an older boat. Having to put that much money into an older boat scared the heck out of me.

Glad to read that the seller made you a decent offer to stay out of court. I'm very curious to see how this all ends...

Very sorry to hear about your boat problems, however as it has been said so many times....
is everyone paying attention now........" this is why a marine surveyor earns his money" had the couple hundred bucks been spent for a quality inspection this could have not been an issue.
Folks spend thousands for a boat but want to cut corners by a couple hundred and not do things the correct way. I enjoy this forum but in many cases alot of problems occur because people cut corners to save a few bucks. For example...look at the number of cracked blocks from winter freeze because someone took a shortcut to save a few bucks and a little time, or want to substitute a cheaper "will almost fit" part. Education comes at a high price sometimes, if you like the boat, then bite the bullet and get it fixed correctly and considered it a lesson learned. If you are not that impressed with the boat then bite the bullet and get rid of it and start over with 'lessons learned" We have all probably been there, it is just whether we go back a second time!! Best of luck...keep us posted.

it is very possible that the manifolds are toast....cracked.....they crack internaly and will allow water into the cylinders.....

i would also look at the cooling system in general...including the main water circulating pump. no you dont need marine.

i would also look into other issues with the boat.....look in our dry dock....(the restoration section of the forum)

the boat might not be worth repairing. issues like soft decks, waterlogged foam, rotten stringers and transoms. are very common on older boats

I've seen several non marine water pumps fail and cause overheating issues.... the impellers rust away... marine with stainless IMHO is worth having

i really appretiate the support.
as far as surveyors go, i didnt know they even exsisted until after i bought this boat and started looking around.

i have always, since i was a teen, had older runabouts (all outboards)
none anywhere near new,
heck (i got a 64 twain 15 ft.closed bow v sonic behind my shed been sitting for 4 years) sweet lines, that gunner rolls with a 115,
character everywhere but small
the newest boat i owned was a 93 bass buggy 18 pontoon which i just sold to make the needed repairs on the rinker.

so, i am certainly new to the i/o's as well as the cuddys
i am glad i got my preferred mechanic onboard to get me properly rebuilt and all fixed up!
i need the trust and comfortability that has been missing with this purchase.

agreed, just because duct tape holds a waterline from leaking doesnt mean it is just as good as a new hose.

funny story,
last trihull boat i bought before the toon, my brother gave me (a full roll of duct tape)
odd, i thought, but half the roll is gone.
lol (only a little of it was needed to hold my teeth in place)

boat is solid.
i did check the transom, motor mount logs, decks, hull(i think i did a good job there anyway)
those older boats taught me what to look for.
yes i did buy a few summer rides in my years that after winter made me wish i was a "tinny"(love that thread)

manifolds pulled,engine pulled,ready to start work
waiting to hear the bear and buck my mechanic got.

hi all,
engine remanned and ready to go,
2 days running in the shop, nooo issues
and now its back to sleep

step 1 is done more to come
outdrive rebuild next
then we will play around with accsessories!
cant wait.

forgot to mention,
timing was too far advanced,

one head was warped, odd side
a few valves were slightly tuliped,even side

water scoreing in one cyl ,odd side
oil rings bad in a different cyl, also odd side

half of the pistons wristpins were super tight

no blockages found anywhere
engine remanned/rebuilt
running cool now
