I agree, 40hp is the USCG limit.

All of these tests were done in international waters on a closed course by professionals under the close supervision of full safety crews and should not be attempted by anyone.

The Yamaha 3 cyl 40 would probably be a great motor. I just never ran a 13 with a 40 personally.

Ive owned and rigged multiple 13' whalers.My personal preference is the new Suzuki 25,its safe,light,quite,economical and fast.Something I did not realize is that you can blue print the bottom of hull to pick up some performance on the cheap.If you prefer a 2 stroke I think this is the last year Yamaha is offering there 25 which is 105lbs.
