Friends do sue friends, happens all the time. Say your friend makes a swan dive into the shallow end of your pool, neck injury, long time disability if not permanent quadraplegia.<br /><br />You're good friends, he accepts his responsibility as he knew better, but his medical insurance runs out. You'd pay all you could, but you'd end up living in a van down by the river without even making a drop in the bucket. But, you have this umbrella policy or personal liability or whatever. There's the deep pockets. You aren't adversarial except in the courtroom.<br /><br />These guys are both millionaires. If D!ck is half the man I think he is, he'll be there for Whittington should the need arise.<br /><br />But if the worst case scenario should eventuate, well, the estate might have some kind of fiduciary duty to obtain a settlement, with or without a lawsuit.<br /><br /><br />Note to Zmoz, agree, wrongful death award measured by lost potential earnings, but estate can also sue for pain & suffering which can be a whole lot more...I can tell you from experience...most wrongful deaths are worth right around $2 million (apart from pain & suffering, and any punitive damages in the case of gross negligence). Did you know that punitive awards are taxable to the recipient, whereas "actual" awards are not? Remember that in your next settlement negotiation.
