Boat Gas and Taxes

Last weekend I was talking to someone about boating. They had a large 40'+ boat and when they fill up with gas its 500 gallons at a time vs my 30 gallons at a time. They asked me if I put the gas I use for boating on my taxes. I said no and asked what they were talking about. There version is that somehow they are able to put the gas for the boat on their taxes because the gas has a road tax built in and since boats don't use the road they get that tax back. Is this true and how do you keep track (ie prove) that the gas was used for boating. Seems like the Farm Diesel fuel issue.<br />Any input?<br /><br />thanks<br />Chris

don't think it is legal, but not sure. some states will refund the tax on a yearly basis (i know deleware does). you fill out a form, send in the receipts, and get some cash back.

in va its something like 19 cents per gallon. when u do your states tax you are supposed to be reimbursed all that u have reciepts for. 1st year boater so ill see for sure.

Completely different for every state. Here you can get a gas tax refund for all offroad use EXCEPT pleasure boating. :rolleyes:

Here its not cash back. But it is tax DEDUCTABLE.<br />If your paying in, you can deduct the amount from moneys owed, If you dont owe any state taxes, <br />WELL.......its a wash, they win. :eek:

You can deduct any portion of the gas tax that is designated for road improvements since marineis not road use. All gas stations on the highway charge this tax. I don't know about marinas that sell gas. In any case to claim the exemption to the tax you need to save the receipts and file them with your return or at least retain them with your tax records.

Exactly! Don't feel bad ZmOz, it' the same here in MN. Can't claim Atv, snowmobile, or boat gas either. :(

Registered boat owners should try to be as accurate as possible when providing this information.<br /><br />On the renewal registration form it says something along the lines of<br />" Overreporting fuel usage does not effect registration fees."<br /><br />At least here in Pennsylvania the PA Boat Commission gets the money.

Gee, you got a bunch of technical answers. When I saw the headline "Boat gas and Taxes" all I could think of is that both are inevitable!

For folks in California, fuel tax collected for use in aircraft and off-road recreational vehicles is not refundable. Seems fuel tax collected for fuel used in boats may be refundable, as boats are not vehicles used ‘off-road and on land’ for recreational purposes.<br /><br />Gasoline Tax Refund<br /><br />The Bureau of Tax Administration administers the gasoline tax refund program for the State Controller's Office (SCO). The Bureau processes refund claims for state gasoline tax that was paid for exported gas or gas used for off-highway or para-transit purposes. I also found this article so I guess it depends in what state you are in & doing some research to see if you can claim where you live. I will see if I can find something for Florida & try to get a refund if I can. web page
