I would not push it with this company. Sounds like they are willing to fix the seats. Now taking it to a shop and asking them to dismount seats and have Chap pay for this as well is pushing it in my book. If you turn this into a major hassle for them they may just say forget it and tell you to pound sand. Not saying they will but I would take what they have offered gladly and pop the seats off and on myself.[/quote

Asking a mfg to stand behind its warranty is not pushing it.... Getting non biased professional opinion's is not pushing it.... documenting the problem is prudent...The man making the final decision would be in a postion to say yes to a warranty claim if all the ducks are in a row and showing clearly a mfg defect is causing the problem...and not be in a good postion to say no if the issue is clear..;)

This need not be a adversarial claim nor is this post. Warranty claims are a expected part of doing business.....It just there are times when individuals take it upon themselves to make decisions that they should not be makeing...;)

I guess the question is whether or not this boat is still covered by the factory warranty and what the warranty covers. If it is a 2 year old boat then I doubt the warranty is really enforceable as I think this boat has a 1 year warranty on stuff like this. If it is a brand new boat then I would think the dealer would be able to help with deinstall and install of any warranty replacement seats. My point was, if the boat is out of warranty and they are willing to swap the seats for goodwill then I would not push it.

If I was a betting man, I would say his boat is out of warranty. First it doesn't appear he did the warranty transfer paperwork as outlined in his manual and pay the $500 transfer fee for boats under 24ft. Boats over 24ft the transfer fee is $1000. And as stated in the warranty section the 2 year canvas and the cockpit upholstery warranty is NOT transferable. READ YOUR PAPERWORK.

Nothing to transfer. He stated it was a new boat with 0 hours on it when he bought it.

I have never bought a new boat. My theory has always been to let the first owner eat the depreciation (and yes, boats DO depreciate). So I'm not well versed in boat warranty issues - BUT - I'm gonna guess upholstery is either not covered at all, or covered for a very short time. The manufacturer has no control over the abuse that the relatively weak upholstery might be subject
to - excessive time uncovered and subject to weather extremes, forgetting about the screwdriver in your back pocket and sitting down, ect, ect.
If Chaparral is willing to inspect (and likely replace) the seats, than kudos to them for being a straight-up company. Don't kick a gift horse in the mouth.

The line between unfairly bashing a company and holding it accountable for its business practices is a thin one. We have heard some real horror stories in regard to warrantees here, and many of us have been pretty strong in our reactions to the companies involved. I have been one of those people and that is true, because I have become very disgusted at what passes for business ethics these days.

That said, it sounds like you have managed to get around one person who acted like a jerk, and have gotten to someone who is showing genuine interest in your situation. In any company, there are going to be people who are dopes, but none of us should condemn the entire company for that fact. Since Chaparral seems to have a corporate ethic that is not what was initially demonstrated to you, and it has offered help, my advice is that avail yourself of such help in the most simple manner. I would not involve another repair facility at this point, because doing so will just complicate matters.

Its really about the trust factor - when someone gives a customer a reason not to trust a company, whatever that customer chooses to do is pretty much fair game. On the other hand, when the company steps up and acts reasonably, returning that good faith is usually a good idea.

Ya know guys this thread has kinda had it's little ups and it's little downs, but no extremes. Maybe a little vanilla, but potentially controversial threads like this will stay open that way. Excellent, thanks!!
