I have a rather complicated situation, that I hope SOMEONE can help me with.
I have a great aunt who recently has fallen on hard financial times, that my father sold a boat to in the early 90s. I have been posting about it in the MFG subforum. It's a 1965 16' MFG Niagara. Needless to say, she gave me the boat, no strings attached (other than that I can't "sell it to my father or any of his agents"...long story.) The boat did not have a title attached to it in any way, shape or form, which I did confirm with my father. The boat HAS been registered in the past, last active reg was in 2002. The boat was last registered in NJ, and I live in NY. The trailer also has expired tags, but I plan on scrapping the trailer and just winterizing it in my backyard on struts/cinder blocks (I live on the water, it's just a matter of having a hauler lift it.)
The only "proof" I have that I know of that would establish the boat now being mine, is a notarized letter stating that she gave the boat to me. She DID give me all of the past registrations, stickers and all (as the boat hasn't been used in over 10 years, but she WAS paying the registration), but I fear they may have been lost when my house was flooded in Hurricane Sandy.
To make matters worse, my aunt is, for a lack of better words, crazy. She has since cut off (or at least considerably lessened) communication with us, and would make matters very difficult in getting replacement documents, or any other proof of ownership materials I might need. On top of that, I found a form on the NYS DMV web site, form DTF-802, "Use this form to certify sale price for sales tax calculation when vehicle, vessel, etc. is transferred in a casual sale or as a gift." which can be found at http://www.dmv.ny.gov/forms/dtf802.pdf
She has become VERY calloused towards my family, and chances are, we cannot even attempt to contact her to sign off on any of this, let alone get her to contact the NJDMV to help us out. My girlfriend, who had sold stuff on eBay and needed to give her money for items, can't even get in contact with her, and this is over giving someone who is broke free money!
Is there any way out of this? Should I just stop wasting my time refitting this boat and have a junkyard or charity come and haul it off? This boat is my childhood, and I would be devastated if that was the case. Please tell me that there is some light at the end of this tunnel. Thanks in advance!
edit: Upon doing more research, I found http://www.dmv.ny.gov/forms/mv51b.pdf Statement of Ownership for Non-Titled Vehicles, Boats, Snowmobiles and All-Terrain Vehicles - MV-51B Upon FURTHER research, that's a "part two" to MV-51 which is a bill of sale, which there was no sale. THE DMV CONFUSES MEEEE
