Re: Feeling cheated by Evinrude/Bombardier

Man, I would say that some are jumping to conclusions here!! First of all! Bombardier has about 10 jillion of these motor extended warrantys and money rebate forms to focus on right now. Does that excuse someone from Bomb for not getting back to you immediatly?. Lighten up and give her a call back. She is probably up to her eyebrows with forms and people/dealers who just didn't fill out the forms right, didn't sign it correctly, didn't know if they wanted the money or the warranty, didn't get the paperwork into Bomb on the LAST DAY, .................... As a dealer, I had to spend the last night of the promotion (past 10 pm.), faxing back all my paperwork for all the motors I had sold, in order to beat the deadline! Bomb said they would NOT accept ANY after that date so I had better get them in!!! No excuses..... Just give them a call. However, I suspect that they (the dealer) should have gone to bat for you sooner!! It really is not Bombs fault that he did not! So don't blame them! Remember, their are millions of dollars on the table. It needs to be administer'd correctly and lawfully!!! Tell the dealer to make you happy, or at least happier than you are now!!! BTW, if you "purchased" the boat on the 15th, then that's the day the contract should say! Just rewrite it to say so! I have written may a contract based on a telephone call though the customer didn't come into the store 'till two weeks later! No ones trying to rip off anyone, just taking advantage of the offers provides as a selling incentive!! BUT, these offers are time senisitive!!! Isn't that the point??

P.V. It would be easier to accept the possibility
that it was only a paper work overload problem,
or Kady is over worked and doesn't have enough
time to return a call after more than 2 weeks?

So thats a reasonable excuse for misleading information?
and refusing to provide any kind of resemblance
to service?
I dont think so, I have spent 25 years in sales
and service, and never treated a customer that way.
And If I had treated my customers with misleading
information and poor service, I would most
certianly be doing some other kind of work by now.
As you state it sounds like he could of provided
the insentive if he wanted to. So what do you
think he is trying to hide? ;)

Well, I gues I better not tell you that today I recieved all my rebates (I had them come to me as I gave the $$$ to the customer at the point of sale). ...OK, Let me start over, ... Your dealer is a "schmuck"! I guess you have to figure out if you still want to deal with him!!

P.V.
I gave a $2000.00 deposit on this boat and motor.
Any thing you can add to to help me get my
deposit back, without going to court would be
DEEPLY appreciated.

Hiya,

I dunno what province you're in, but I will say I've had some limited experience (all good) with small claims court. Costs something like $5 to file, a few bucks to serve them (can do registered mail)... could sue for return of your deposit. You just present your arguement, give copies of papers the judge it seemed very straight forward. You don't even need to get into the he said/she said about the promo... dealer hasn't supplied product in timely fashion, it's summer, you want your deposit back. Was there a "delivery by ... " date on your receipt? Downside is that there might be a few week wait for date.

HTH,
Brent

Hi BF, Time frame was verbal. 3 to 4 weeks, dealer
assured me delivery would be before May long
weekend. No worries he said. But really its not
the lack of "boat" for the long weekend that has
broken the camels back. Its all the crap along the
way.

Re: Feeling cheated by Evinrude/Bombardier

Nosleep,

Many corporations put their structures together in such a way that there are "profit centers". Customer service isn't typically a profit center and therefor cannot write off an expense above a couple of $'s. The person I would focus on the the territory or regional sales manager. This may be who Kady is trying to contact to get approval to honor your deal. As they are frequently on the road and frequently focused on territory goals as opposed to individual goals they may be playing the flinch method. (Waiting to see if you go away) In addition to being a profit center they are the ones who are maintaining the relationship with the dealer. FYI, this dealer was trying to bend you over, period. Having managed distributors, I knew who was trustworthy and who was a theif. My understanding is this was a huge promotion, supported by TV advertising and tons of coop dollars for local advertising. Frequently these rebates that are paid directly go against a dealers coop advertising (kickback) dollars at the end of the year. By not having you recieve your rebate they would recieve additional dollars either at the end of the promotion or at the end of the year.

On the other hand you still have the upper hand. If you refuse to accept delivery, the dealer will be sitting on the price of the boat, motor, and trailer. And anyone squeezing you for this is probably marginal financially. He can choke on the floorplan costs and their loss grows day by day. I didn't see your entire letter but being "accidently" excluded from a program should midigate the 12hr delay in the date of the contract. Make sure you document the entire sequence of events. Unfortunately your deposit is with the dealer and they may or may not be forthcoming in ripping up this deal.

I wouldn't do busness with this dealer ever. My primary goal would be to get out of the deal. If it means a lawyer then sobeit. If your dealer wanted to help you he would have called the sales manager and explained that THEY screwed up and they need their assistance to help maintain the integrity of the program. This is not fraud. Not offering the program to you on the 12th qualifies as fraud by ommission. Intensional or not.

When this happened to me I asked for full documentation on the dealers part, (make him work for my assistance) but my committment was my dealers integrity and the end users satisfaction and my companies reputation. A good sales manager can read through the BS and make a good decision. Just tell him exactly, breifly and specifically what, when and who is responsible for your dissatisfaction. Be relentless!!!!

Ok, I'd tell the dealer due to "lack of response" on his part, you have decided to not purchase the boat. The timeframe you gave him, and to which he agreed to, has not or will not be met! Are you financing the deal with your own lender or are you using the dealer's?? Don't sign ANYTHING!!!! Tell him you desire your deposit back! Pure and simple! He may not like it, but he'll sell the boat to another customer! Don't threaten a lawsuit! Don't yell!! Just be sure to stand your ground! I'd tell him that there are two ways to go about this. 1) He comply with all of the previously "agreed" terms (rebates, an honest attempt to not "jack you around" any further, possiblly a stainless prop (retails about $400 or so) or 2) he give you back your money and you go your way. I doubt that he would WANT to sell you a boat knowing that he wouldn't give you what you wanted OR your money back. Heck, he may deliver the boat to you (late and not to the agreed offerings), but having a thoughly p#*sd customer right out of the gate! He'll probably think that it's just not worth it! As long as he didn't write "non-refundable deposit" anywhere on the paperwork, you'll be OK!! Good luck, it'll happen! Should I use this opprotunity to sell you a Crestliner also?? Oh, BTW, buy the Johnson four stroke! Much beter than the E-TEC!

If you gave him a deposit in the form of a check, he may be holding it until the boat arrives. Check to make sure the funds have transferred. If not, simply stop payment and start shopping again.

I would suggest that if you don't stand to lose any money, just cancel the purchase and take your business elsewhere.

Re: Feeling cheated by Evinrude/Bombardier

I worked 30+ years for a major aerospace corp. and dealt with many issues of this nature. I can assure you that Bombardier can do any damn thing they want including honoring this promotion.

Without getting into a lot of detail, when Bombardier first took over I had a major warranty problem left over from the Evinrude bankruptcy. Phone calls did no absolutely no good but when I sent a letter to the V.P of Customer Service they contacted me and corrected the problem. Get the contact name from the reps you talk to. Write letters and don't give up.

Re: Feeling cheated by Evinrude/Bombardier

Hello whoopy.
As most know ,I have taken delivery of my E-TEC
motor and Crestliner boat.
I have put this matter behind me and am enjoying
my set up. And both motor and boat have exceeded
my expectations. I did finally hear from
Bombardier-Evinrude, but it it was only for some
lip service, and no resolution to my original
complaint.
So it is always important to deal with a reputable
dealer and Manufacturer.
My hats off to the engineers that designed and
built this motor. As for the suit's that administer
their product they should take a course in customer
service.
