Hey LEO's what can I do here?

A while back my X-wife called and her truck was broke down, well I had a 1984 dodge just setting around. Well I told her I would loan it to her for 3 days, 2 weeks later I caught up with her again and told her if she wanted the truck I would sell it to her for $1000 dollars and she could pay me when we closed on the last property we had. She said she would let me know friday, never heard a word. The property has closed and she paid for the truck. Now here is the sticky part, the truck is in our son's name and she will not show up and change it to her name. So I told her we wanted to see the truck, long story short she has no idea where it is! She gave us many stories about what happened to it. My son and I got together and turned it in stolen (with the whole story of course) to protect my son against what may be happening with the said truck.

My question for all ya'll is ---> What can I do to help locate said vehicle?

If I can find it I wish to recover it and then if she (remember the X) wants it she can do the paperwork, pay any expences to recover it and drive it away!

Disclaimer: I am not selling any vehicle and I am not saying the dodge trucks are what anyone should buy. This is in no way an advertisment for dodge.

Why would you be concerned if the truck was paid for? Just have your son file with the DMV that he sold the truck. The form should ask for the name and address of the Transferee. Budda Bing. He's out from under it.

Sounds like your X is a real case!

here you must be present, have insurance at the DMV to do a transfer (we aint gonna even mention boats). My concern was that he (my son) could be held responcable for what someone does with the vehicle. It would be a relief to me as well as my son if we could find it and look at it, if totaled out fine as long as she had insurance (if not I still do).

You can't really take money for the truck and then report it stolen. If she or someone else gets arrested because you reported it stolen, you're going to be in a big bind. It doesn't matter that she hasn't signed the paperwork yet. The truck belongs to her if she paid for it.

Here in Texas you can file paperwork with the DMV stating the truck is sold. Just show them the bill of sale and a copy of the title filled out on the back. The new owner doesnt have to do anything.

Sorry the law dissagrees with you, we told the officer the whole story and HE told us to protect my son we need to file a report on the truck. We also told her that we are doing this and for her not to drive it without talking to him (our son) first and doing the needed papperwork. She has no idea where she left the truck:rolleyes: if it is/was stollen/wrecked/dead :confused:

Yes, file a report with the police, but you can't report it stolen. It wasn't stolen. You sold it, she paid for it, neither of you bothered to handle the paperwork at the time of sale so who's fault is it.

Well if she was a reasonable person the papper work would have been done. I tried to do her a favor by loaning her my truck which she did not return. Yes I did charge her for it at the time of closing on the last property. If she would do the papper work I would shut up about it. I was hoping that someone here would have an idea that I have not allready tried. At this point it looks like it is gone and no one knows where it went or exactly when, gee I have lost keys but never a whole truck :( anyway thanx.

AFAIK, in Louisiana the vehicle isn't actually someone elses until the title changes hands with a notary present. Money doesn't mean anything. But that's in LA only.

When merchandise just gets "lost" it usually was sold or given away to settle a debt.

Does your X have a drug/drinking problem? This sort of behaviour goes along with drug abuse/addiction.

Mark42 has a point. How do you forgot were you put the TRUCK? It really can't be lost between the cushions next to the remote or left in the other pants pocket that is in the hamper.

waterinthefuel, thats kinda the way it is here, not yours tell you do your thing at the DMV, they could care less who paid for what!

Mark42, I don't know if she has a drug or drinking problem, I think she does.

ricksrster, that gets me that she doesn't even know where she left it, or maybe she is just lieing(sp) to all of us.

What I can say is it has not shown up (and I don't expect it to) in the impound lots. So IF she crashed it, it must be on a private lot. She told us once that it was broke down and in shop, she told us that it had a flat (for weeks) and she could not fix it, she told us she left it at a freinds house and then at an apartment. I wish it would show up so we can put this all behind us. I can tell you that this dumb bass will never try to help her again! See I can learn :rolleyes:

I am not sure that the truck was even sold. Is there a bill of sale? Sounds more like an exchange of monies. Until the title is transferred you still retain ownership, and are therefore responsible. The paper dictates who owns it, not whether your ex gave you (X) dollars, regardless of intent.

I am not a lawyer, and that is who you should be asking. Think of the damage and liability you have with a 2 ton wrecking machine running around in your/your son's name. I wouldn't have my butt this far out there. Especially with the story you are now telling. I lose my keys once a week, I never lost a car or truck, .......................well................... ever! And I can't imagine you have either.

When things don't line up, there is usually something fishy going on. What was her reaction to you telling her you have reported it stolen?

Same here but there is an out. I sold a vehicle one time and the new owner wouldn't register it. I called the DMV and explained the situation. They told me to send them a copy of the bill of sale and my statement that it had been sold. That would end my ownership as far as they were concerned.

If you have proof that it was sold, that proof should stand up in court. At that point, the DMV is just another opinion for the judge to take into account. They may think their silly rules are chiseled in stone, but a judge might have another opinion.

Apologies if I stepped over the line, rwise. I just made assumptions based on what you said....and I do know the deal about 'assuming.:eek:

On the subject of transfering title, I would think all of your state's requirements would be the responsiblity of the 'buyer'. I have experience in three states, they all had an attachment on the title, for the seller to tear off, fill out and send in to the DMV to officially notify them that you were no longer responsible for the vehicle.

In the state of WA, you can even fill it out on line. This relieves the seller of any liability should the buyer not transfer title. I know of no case where the seller has to do anything else but sign off on the title and notify DMV of such occurance.

According to the WA Dept of Licensing website, the following information is all that is needed for a seller to fill out a 'report of sale'.

How to file
Information you’ll need:

The date of the sale or transfer.
Your name and address.
The name and address of the person the vehicle was sold or transferred to.
The vehicle identification number (VIN).
The vehicle license plate number.

Two ways to file
You may file the report of sale:

online for no charge.
OR
in person at a vehicle licensing office. (Additional service fees may apply.)

I wish it were a joke, the edit was/is the disclaimer, the edit note is a joke put there because of another thread :rolleyes: that I got edited in, nuf said...

I wish this state had that, here you go to the DMV and do the transfer once the title is signed in front of them the seller can go. You can just go to a notary, but you have no warrenty that they will follow through with it leaving you responcable for said vehicle (or at least having to go to court to prove you sold it). However, the officers from both counties (I am on the county line) said that the theft report will forgive responcability, still I would like to see it just to know what happened and if there is anything that could come back later.
