He said the warranty is only void on the repaired area, not the whole boat. There may be a case for a new boat, but again, like the other thread similar to this one, we don't even know what the damage actually is yet, not even a pic in this case, just a couple sentances describing it. I do think this is a very unfortunate situation for both parties and bigtree should be made whole. That means if it's repaired, he should be compensated for the loss in value of the boat.


There are very few time's i would question you advice, actually none in terms of recon..you own the day night or what evea. But no mfg can limit the orignal terms of a contract......unless that is the orignal terms have been ...umm violated..and it has been...err they have been.

Good guy aside any attourney could or would tell you no actually articulate the mfg has no more responsibility towards this boat it was severly damaged....ya da yada yada..

Boom done...Ben there done that and it sucks..;)

The only info I have to work with on this is what Bigtree said , and that was the repaired area would not be under warranty, but the rest of the hull would be.

I don't know if you go trying to get yourself a new boat you might end up out of luck.

Sure I know no one wants to hear this this but were talking about a used boat that's on it's second owner.

The value of the hull is not even remotely what a new hull costs and that was what got damaged. A used hull.

At most the dealer would be responsible for paying you the value of the hull and you can go find yourself another deal.

What is Lund''s concern?

I would imagine it's the corrosion resistance not the quality of the repair.

I'm not trying to bum you out I'm just trying to point out that if you go in there spouting off about wanting a new boat to replace the used one you bought and odds are you'll find that stand up dealer correcting an accident go into protect mode or cover your a** if you will.

I would ask for he repair and then some cash. Very similar to other stories here, but you never know how long a dealer will be in busines these days. We bought a car with some covered up damage and wasted time going to court and in that time the dealer went belly up. We could have had a repair done and moved along. Now we have the car with some damage and no dealer to get resolution.

Add up the costs, deduct your lawer fees, etc. what will you end up with? Get the boat fixed by the dealer and see if he will sweeten the deal.

From your description, it sounds to me like they'll be able to do a good repair on your boat. I can't see where they owe you a new hull on a used boat. However, you can probably get them to throw in an accessory or two to help compensate you for your pain. A nice GPS or something.

I would ask him how, exactly, he plans to do the repair.

Get the boat fixed by the dealer and see if he will sweeten the deal.

that's what i'm thinking too...maybe an oddball way to back into a sweeter deal and let him get rid of that boat? doesn't hurt to try, he'll probably ask at some point what you think will make you right. you need to have an answer because i don't see a new hull coming out of this either.

Here is a picture of the damage. The impact effected both sides of the boat and pushed in the frame on the corner. The dealership is willing to send it to someone that builds alum boats in my town. I don't really feel that happy about getting it repaired though. I've nenver been totally happy with repair jobs.
Lund will definitely not warranty it once its opened up. I loose the ten year warranty where ever the damages are. They say, everything that the repair touches, voids the warranty in that location.

Having some experience in body work and painting, even though this looks small enough, I can't see it being that easy to repair without having to pull it apart quite a bit. At least if they do it correctly.
What do you guys think?

Looks to me that they'll have to open that seam up most of the way down, straighten out the metal and then re rivet it back and give it a shot of paint.

Considering it's not a "structural" part of the transom, there will be some metal fatigue after they hammer it back out. I think it comes down to how much you trust the dealer/repairman.

The dealer caused Lund to void the warranty-dealer owes you a new boat.

Once they have an in(that non warranty led to other damage...)
screwed. Lawyers do that to us.

Not as bad as I was envisioning not to say that it dosen't suck

I would ask for a full paintjob if your do end up getting it repaired

sorry, I mean besides the corner post... the transom and left side of the boats sheathing ( I think that's what its called?) is buckled out about an inch as well. How do they fix that?
Wouldn't you have to pull the sheathing out a fair ways to staighten the beam first?... then, somehow flatten out the sheathing` ( stretched metal will need to be shrunk a bit)? Seems like the top cap of the gunnel would have to be pulled as well. Its a domino sort of, yes?

Then a full paint job and decals to match. Blending paint seems mickey mouse yes?

The local dealer ( a Lund dealer yes) who whacked the boat.

After I saw it, I thought to contact Lund before I committed to anything being touched ( waving my rights). At that time Lund told me about any repairs being done to double riveted areas of the boat would void their 10 year warranty to any area the repair touches or relates, and... to the life warranty to the wood if that is in any way related to the repair as well.
If done properly, the repairs become a bit of a domino effect yes?
The dealer who hit the boat is now getting angry and trying to down play it all. They think its a little repair ( $500 or so...) I say ya right.... They also say if I wanted to sell the boat I wouldn't have to disclose the repair. That tells me how they are planning to repair this and what kind of a dealer they are. Like I could in good conscience sell the boat, something breaks open in 5 years and the new owners think they have a warranty.
The red flags are appearing now. I'm getting concerned.
I think this is many thousand.

I found this site and we are here.

Someone asked me who the dealer was but, at this time I don't want to say anything about who it was..
Note: the sticker on the boat that says Cars is not the dealer who hit my boat. It happened at another Lund dealer.

sorry if i missed this but what did Lund Corporate recommend you do to retain full warranty? Can't Lund call this dealer to give them a push to make things right?

Hi azlakes ,

At this time, they have only said what I am repeating to you all. After we told the dealer who hit the boat, what Lund said... , they sent pictures to Lund and wanted a conformation of what we told them. I'm thinking those pictures might not have been to clear either so I just sent Lund my picture tonight.

My wife has spoken to someone at Lund who has been very helpful and sorry for us. They have basically made us aware of what the outcome could turn into.

If this happened at a Lund dealership, Lund needs to be responsible for the repairs to an extent that will maintain the warrantee. Even if this means shipping the boat back to the Lund factory for repairs.
If the dealer pays to have it "fixed" then you can bet they are going to do it for the cheapest price at Billybob's Paint and Body.

If theire willing to fix the boat repaint it and give you a warranty then I dont see a problem with that. You guys make it sound liek the boat is totaled or something. As long as theire willing to fix and warranty the damage then i woudl tn loose sleep over it. Find out the length of the warranty of the repair is. if theire taking it to a alluminum boat shop youll be surprised what those guys can do. I had a jet ski that got hit pretty good and they fixed it and i coudlnt tell the difference. if the damage is more than the boat is worth ( and I dont think it is) then the insurance would total it out. I think the dealer is trying its best to make a bad situation right. Theire not trying to get shady at least I dont see it anywhere. I woudlnt loose sleep over it. if it was a car it woudl simply go to a body shop and get fixed. jsut go and see the place where they plan on sending the boat for repairs. youll either get a bad or good feeling depending on the shop
