in my bill of sales, i just plainly put. " buyer has inspected the item, and is fully statisfied, and accepts, it in "as is condition" be sure to get there identifying information. this is in case they do not register it in their name. and a incident occurs.

Maybe I'm missing something....was there a patch on that hole when you owned it that came off? If not, dude put a big hole in the boat and it sunk. How can he say it was there already - was he blind when he looked at the boat? If he saw it and "tried to patch it" why didn't he call you THEN.

It's a $900 boat. If you pay him a dime you've just contributed to the outrageous litigation problem our country has. if someone can sink a boat then use the courts to scare someone else into paying, then it will just keep happening. Tell him very impolitely to screw off and don't call you anymore.

So what if he sends you pictures of the damage? It's his boat, you didn't drive it when he sank it, and unless you sold it to him with a warranty of some sorts it's his freaking problem..

dont let the sold a boat and it broke thread scare you that guy is just very unlucky and he would have won in appeals anyway.. you are not at fault for anything here and i would kindly explain this to the buyer of HIS boat..dont be rude because anyone can take anyone to court for just about any reason that doesnt mean they will win but i doubt you wanna spend any time there so just lay the facts on the table to him..

After some more thought, I sort of figure his day when like this, new boat, dumped it in the water and took off, sans the drain plug, the stern sinks, it gets towed back in, they then try to winch it up on the trailer, full of water, and punch the hull with the end of the trailer's bunk.

All said and done, it's not your responsibility to train a new boater, nor to warranty a $900 boat. In many states, any vehicle sold below a fixed amount is automatically considered to be "AS-IS" or without warranty. I believe it's $2500 here. A buyer can try small claims court but with a boat, a win is unlikely.

It's sort of like buying a turkey at the supermarket, burning it to a crisp in the oven, and trying to take it back saying there's something wrong with it.

no kidding. if he does try to take you to small claims court let him. its going to get tossed out.

I once sold a 20 some year old car with 200k miles on it for $500 to a guy. he calls me back a month later and tells me I sold him a shoddy car and is going to take me to court unless I give him his money back. turns out he never transfered the title. so instead of dealing with all that I gave him $200 and took the car back. I then resold it for $700 :D

Just to clear things up here, my Friend didn't buy the boat. (and if my friend wanted it that badly, I probably would have just given it to him, but thats not here nor there)

My friend was with me last time we took it out, he could be a key witness to its excellent performance. I sold it to some guy from the penny-saver. I don't know him, and have spent less that 10 minutes of my life with him.

So I got a bunch of missed calls this morning, all were him, the only message was.

"Brandon, you have until tomorrow to give me my money back"

So work has me out in Vegas until mid august, leaving my home and stuff unsecured.

So mind you,
A) I'm 400 miles away from said buyer
B) I have had no communication with him since the creation of this thread
C) He can **** right off.

Ill second the dont respond and record and save all forms of correspondence. a few years back I had some issues with an Ex GF and I simply ignored all forms of her contacting me and saved all emails, letters and voice mails. the case she tried to get against me was thrown out before it even went to trial.

even if it does go to court, im sure the first thing the Judge will ask the guy is if the boat had a hole in it, why did he buy it and put it in the water?

I sold my bronco to a kid a couple of weeks ago. He calls me from a gas station 4 miles away and says its leaking oil. So I jump in the car and hightail it down to the station. When I get there the truck has leaked a puddle about 8" in dia. So we crawled under and determined TOGETHER that it was coming from the pan gasket. I apoligize and remind him it sat for 4 months, and I did not know about the leak as it never lost ny oil when I was driving it. I ask him what he wanted to do about it and if he wanted his money back(I kinda missed the bronco already). He said he would top off the oil and drive it the 75 miles home. I dug in the trunk of the car and found him a gallon of oil and wished him luck. 6 days later he calls me and says his daddy looked at the truck and he thinks the rear main seal is leaking, "what are WE going to do about it?" I told him WE arent gonna do any thing about it, YOU are gonna put a seal in it and drive it. His momma called right back and got the same treatment. I havent heard back since:D

I think you should refund the poor fellow's money. And then offer to buy him a new boat to replace the one you so carelessly sold him.

This guy can't be serious. He even admits that he doesn't know how to handle the boat you sold him.

"One time while starting starting the engine it went on reverse while the control shifter was on neutral!! "

yeah, usually I would agree, but I saw that thread about the dude that sold his boat, got sued and lost. then won the apeal when the buyers didnt show.

Yep, that was me. The kid blew it up the next day. Now you guy had it a week? and apparentley did some work on it?

How do you not notice a hole in the hull?

I've been on the other side of this, as I 'm sure other people here have. Bought a boat for 5k, supposed to be "ready to go", 3k later it was "ready to go".

I must admit that I did try to prove the seller knew about the problems by contacting local shops in his area, I did find information about the head being rebuilt but that had nothing to do with the problems I was having. Therefore I did not pursue it any further. My attorney advised me that I would have to prove the seller knew about the problem. This was an as-is-sale btw. After I got the repair done I learned it was more of a manufacturing defect.

Glad I didn't waste my monies.

Anyway I post this because he has to prove you knew something about it or he aint gonna get crap, atleast here in TN.

So I join the don't do crap crowd.

He said he would take anything so I sold him a 72 Buick LaSabre (BIG ol' land yacht) for $100. All the tires were flat on the ground so we pumped them up and I told him to take it down and have the tires replaced. Next week he comes in complaining that he had 4 blowouts...

My response,,, Well what do you expect for $100?

I found out later he drove the thing 500 miles on the bad tires,,, it must have been like driving a circus wagon :D

On the boat problem, sure s*cks that HE ruined HIS boat :rolleyes:

I had a buddy do the same to me, I gave the guy a pickup, (which I had been stripping for parts), that had no tires on it, and was missing most of it's interior. I told him that if he went out back and found four 15" tires I'd mount them up so he could tow it home. I put 4 used, well worn tires on it, they were even all the same size and the correct size at that. He proceeded to jump start the truck, which also had no exhaust, and drive it home. I didn't hear from him for a few weeks when he called screaming at me saying the truck had left him and his family stranded 800 miles from home and had cost him a fortune to tow home. When I asked what all he did to the truck, he said "Nothing", it ran fine so he took it on vacation. Four bald tires, no exhaust pipe, cracked windshield, front seat nothing but springs and unbolted, no rear window, and no shocks and only a couple of working brakes. He took it home, felt it ran and drove fine so kept driving it. He never even registered it. I still had the title in the safe at the shop. He seriously wanted me to pay for the towing and repair. He got the hint after I stopped laughing. I told the fool he should be in jail not there trying to bilk money from me for a truck that should have never seen the road again.
I had given him the truck since he had a similar truck at home that had been hit in the rear, figuring he'd use the bed and maybe the frame to fix his. The truck I gave him was rough with lots of miles too. I bought it for $50 and taken more than that off it in parts and no longer had a truck to match.

I haven't seen him since. I'd have loved to see the look on a judges face when he heard such a story. (....."Well, you see your honor, I was driving this truck with no insurance or registration with my family inside with four bald tires and no brakes when it just quit on me" ..."What? Do I have proof of ownership?)

When he got that thing running, I never figured anyone would take a truck in such shape down the road, especially late at night. When it started, he headed right out and never came back with it. Never even asked about a title. I had never even transfered the title over, it was in the name of a deceased former owner with a state issued reassignment certificate attached from his estate. So technically he couldn't even say it was mine. It was junkyard bound if he hadn't of taken it.

It all just gives some insight to how some people think. I'd have not even considered using it for a field vehicle it was so rough, yet he thought it was worthy of a family vacation.
