This is truly great news; I hope all keeps getting better. Keep a watch out for that contractor if he is that crooked then I wouldn't put it passed him to try and mess with you somehow.<br /><br />I wonder if somebody said something to the town? I find it strange that the town has turned around completely after threaten to throw you in jail again.

Sounds to me as if someone knew they had screwed up and were giving you the run around in hopes you would just leave but have since realized they were in to deep and decided they had better do what they can to rectify the wrong to be in a more faverable position in the eyes of the court because that is where this ones headed.It is my guess that there will be several trials over these errors of imense proportion.

I will start by saying, good job with sticking with it! No one should be put through this. <br /><br />It also sounds like the town is trying to put the blame on the contractor to ease the case off them. Don't let the town out of this law suit. It is a huge neg. on their part and they should not only pay for the damages, but pay for neg. too. <br /><br />I am happy for you that justice is finally yours. It is about time the good guy wins in the end.

great news i wonder if the town heard insurance company lawer and thought thay better do something don't take them for to much thall just raise your taxes to cover it really happy for ya

Had this fiasco once up North; sued the INDIVIDUALS!<br />The Councilmans' wives sure got it settled!!!!

Hi all,<br /><br />Thanks for all the posts.<br /><br />Sorry I have not responded sooner but I have been in court with this thing.<br /><br />The contractor has lost all permits for this property.<br /><br />He has been ordered to destroy one of the 2 homes already built and has 10 days to do so!<br /><br />He was also ordered to restore the property to its original state within 120 days.<br /><br />He was ordered also to pay the county and state $3 million in damages, and his permit for a building contractor has been revoked, meaning all construction projects he has under way anywhere in the County, must stop!<br /><br />Now for the Town...<br /><br />They were ordered not to issue any more building permits until the state and county can review their procedures for issueing permits.<br /><br />They were also fine $1 million dollars for not following their own ordinences.<br /><br />The Judge told them that if they were not going to enforce the ordenences that they enact, then why write them.<br /><br />The investigation has been turned over to the County District Attorney.<br /><br />Well...thats where I am on this for issue now, and it looks like things are going to be better, although maybe not perfect, but at least the County and State agreed with me that water on my property, caused by others, should not be my problem.<br /><br />Now maybe I can enjoy my home without outside interference from greedy builders.<br /><br />Once again, I thank everyone who responded, your ideas and encouragement in this matter were extremly helpful, even when I needed to vent my anger and frustration, you guys and gals were there for me, and for that I am grateful.<br /><br />Thanks...<br /><br />Kenny

Just recieved more info...<br /><br />The Judge has ordered the contractor to pay for all damages done to my home and all other homes damaged.<br /><br />The Judge also ordered the contractor to pay me 20% of the damages to my home as restitution.<br /><br /> Finnally, justice prevails !

Thats GREAT news Kenny. Glad it worked out ok for all involved. Sounds like there might soon be some job openings on local goverment level :D :p :p :D

Hi all,<br /><br />I never considered running for an elected position before, but after all this, there are alot of people around here that have made that suggestion.<br /><br />I don't know if public office is where I'll be heading, but it is nice to walk down Main St. and people thank me for what I acomplished. (I don't feel I've done anything other than protect my property and interests, but alot of people said that they would not have fought the Town the way that I did.)<br /><br />The home that was ordered destroyed, was torn down Saturday morning.<br /><br />From what I've heard, the contractor is still in the County Lock-up, awaiting additional charges.<br /><br />As of today, I have not heard a word from the Town.<br /><br />Heavy rain over the weekend has caused additional flooding in the area, but the property has not been restored yet, so I guess I can count on this flooding until then.<br /><br />Well, maybe now I can get the boat in the water this week.<br /><br />Kenny
