Its great the way it all turned around for you and your neighbors.<br /><br />As it all unfolds in court it'll be interesting to hear why he was allowed to proceed without the proper permits. I agree with Mellow. Get it in writing with the town you want some immediate remedial action. They've got deep pockets, and they cannot claim bankruptcy, so they are likely to react.<br /><br />As far as the judge granting a payment order from that contractor, that's great news, but I would not spend the money before I saw the check, and it clears the bank. Any insurance the guy may have had is probably void if he broke the law, and most contractors seem to be on the edge of going bankrupt on a virtually constant basis--I'd be surprised if he actually tears down that house, let alone pays you restitution.

Hi all,<br /><br />Heres some more info...<br /><br />The Judge was at the properties yesterday and declared that the Town FAILED to conduct an Enviromental Impact Study and that the property WILL be restored to its original condition within 120 days .<br /><br />The Judge ordered the third and final home destroyed and the property returned to the condition it was before the contractor cleared it.<br /><br />Any and all streams are to restored to their original condition.<br /><br />This means that the contractor has to replant all the trees on this property with mature trees. (These trees will propably cost the contractor $2,000 to $3,000 per tree, and there were approx. 67 mature trees on the property that were removed.)<br /><br />The judge also ordered that all fill (dirt) that was dumped on the property removed, and the original grade restored.<br /><br />The contractor was there with the Judge, and he told him that he was not going to do anything the Judge ordered, claiming " it was his property and he can do whatever he wants with his property ", so the Judge had his butt dragged off to jail again, for contemt of court!<br /><br />He had just gotten out of jail about 4 hours prior to this meeting, after spending 2 1/2 days there.<br /><br />Ha, Ha, Ha, Ha, Ha, Ha, Ha, Ha. Serves him right!

kenny, since you really have no idea when the town or the contactor is gonna reslove this problem, I reccomend putting in a temp. drainage ditch to keep the water away from your foundation. who knows how much damage could result over the next several months and even though they are ultimately responsible, it could take years and lots of $ in legal fees to get them to pay for it. you can always fill in the ditch later and it will divert 100% the water away from your house.<br />good luck,<br />M.Y.

Hi mellow,<br /><br />That sound like a great idea but...<br /><br />Here, you have to have a permit to dig in the ground, no matter what, even if its a fence pole, any kind of digging requires a permit. :confused: <br /><br />The Town will not give me a permit for any kind of digging at this time. :( <br /><br />Had the Fire Dept. come down again last night to pump out the basement, but it needs to be pumped again. :rolleyes: <br /><br />Kenny

u gotta be kidding me? seems they should make an<br /> exception in your case... several months of water<br />can cause lot's of damage and aggravation.<br />of course, they don't seem to bright anyways.<br />u can pick up a sump pump at value for about $50<br />in the meantime to keep the water from getting<br /> outa control.

Yes it is !<br /><br />Another problem in this area is that there is only 5 ft. to ground water, to make matters worst.<br /><br />It really sux living on an island !!

Hi all,<br /><br />Just an update.<br /><br />As of yesterday, 6/10/03, the third home was knocked down and the the property is in the process of being returned to it's natural state.<br /><br />The new owners of the third home are suing the contractor for the cost of the home plus damages.<br /><br />Dump trucks have been lining up on the street removing all the dirt that was brought into the property.<br /><br />Have not heard from or seen the contractor since last week.<br /><br />All work being done on the property is being done by the Town.<br /><br />Now that most of the property has been returned to the way it was, all flooding problems have just about ended, and we have had alot of rain here, already 5 1/2" of rain for the month of June, and I don't have a drop of water in my basement (except what remains from the earlier flooding).<br /><br />That's about all for now, I'll keep everyone posted.<br /><br />Kenny

I would apply for a permit to dig the ditch, just in case there was a further problem, and to give you legal grounds for another lawsuit in the future for not letting you do what is required toprotect your property. :D :D :D :D

Kenny, Glad things worked out. I work for local government in New Jersey and thought we had the monopoly on corrupt elected officials. As a side note I would consider going after the town for the time spent in the lock up. There should be some sort of restitution for lost time and aggravation.<br /><br />KEEP ON FISHIN!! :cool: :cool: :cool:
