More News...<br /><br />The County has declared that there will be no trespassing on this property for the next 10 years, to allow it to return to it's natural state.<br /><br />The County also contacted the Real Estate office and advised them that the "For Sale" signs must be removed before the end of the working day, today or they would suspend their Real Estate License in the County.<br /><br />My son came home from school and said that the Real Estate Agent was there removing the signs.<br /><br />We shall see what happens next.<br /><br />Kenny

I wonder if a feasibility study was done by the EPA to determine the property wetlands? If so, can this be appealed by the town or anyone else?<br /><br />I wonder what affect assessing the property as wetlands does to the tax revenue for the township? Will they provide compensation to the township or landowners for loss of use of land as a result of the wetlands designation.<br /><br />I wonder what affect being located next to wetlands does to your property value and taxes?<br /><br />Just a few things I've been wondering. Like Yogi says "it ain't over 'till its over".

LadyFish,<br /><br />I see where you are comming from when you asked what being next to wetlands will do for my property value or taxes, but I really don't think it will have a great impact on the value, but the Town may try to seek revenge on me for not allowing these homes built, and kept from the tax rolls, in which case, my lawyer is ready with a big fat lawsuit against the Town!<br /><br />Kenny

Here in MN just had a farmer covered some wetland on his property and has to pay 120,000 dollars and possible jail time. <br /><br />DNR @ work.....................

Hi all,<br /><br />Just figured I'd give an update before going on vacation.<br /><br />They have completed replanting the lots with huge maples and oaks.<br /><br />Now they are planting wild grasses and all sorts or indiginus plants on the property.<br /><br />The County has posted very large "No Trespassing" signs around these properties, along with larger "Wetlands" signs.<br /><br />Have not seen any "For Sale" signs since the County ordered them removed, but I am sure someone is going to try it again.<br /><br />Now I just have to figure out how to keep the poison ivy from infiltrating my property, but I can deal with that!<br /><br />Well I'm off to Fire Island for 10 days, so you all have a good day and I'll post any changes when I return.<br /><br />Kenny

Did the county get a permit to post the sign's ? You might be able to get the money back that you were fined. Just a thought

my advice... forget all this and just relax on the<br />island! you got lucky buddy and have a feeling the<br />fish are gonna be biting for you :D <br />BTW, me and my kids have discussed this sit. in<br />depth. it's great lesson for us all! after all,<br />the good guy is supposed to win right?

I think if you need a lawyer, since they're so greedy after you have layed the ground work, then they should be willing to pay YOU a retainer fee. HAHA. Maybe you could set up an auction on ebay. They could bid on the opportunity to represent you. <br /><br />Have a good vacation.

Hi all,<br /><br />10 day's of vacation was just what the doctor must have ordered, it was wonderful.<br /><br />Came home to find that the County has erected a new fence, with barbed wire along the top, around said properties and they have finished planting all sorts of trees and other indiginous plants.<br /><br />The lot almost looks like it originally was!<br /><br />Recieved a letter from the Town, apologizing for the undo burden that I was put under during this ordeal.<br /><br />As far as the signs go, from what I have heard, was that Real Estate Agencies have a broad permit to post signs on properties that are for sale.<br /><br />As far as the County's posting of signs, the County can superceed a Town ordinance by rule of eminant domain.<br /><br />Hopefully this thing is now done, and I can now sleep well at night when it is raining knowing that my basement will not flood anymore.<br /><br />Kenny

Hi all,<br /><br />Get this...<br /><br />Last night a neighbors kid (13 yrs old) was arrested by the Town for trespassing on the property next to me. :eek: <br /><br />He was walking along the shoulder of the road, on the grassy portion, and the Town clown arrested him, yelling, "can't you read!". :mad: <br /><br />I think the Town has now really overstepped it's authority.<br /><br />The kid was looking for a softball that had rolled into the high grass and was outside of the fenced area.<br /><br />The kid's parents have already called a lawyer!<br /><br />I can't believe that the Town can be so petty.<br /><br />Kenny

my 2 cents are...<br /><br />I live on a small lake and we fight this type of stuff every day ...<br /><br />In a sense what they are telling you is true, the DENR relies on local resources to inform them of violations, however the DENR can and does come down on local govt for not enforcing the rules<br /><br />1 - DENR - You need to get the local guy, his boss, his bosses boss. The information is on the states denr websites - go up the chain of command. The FEDERAL laws are very clear and believe me the federal guys always want something to do. <br /><br />Corps of engineers dont know about them, our state DENR guys are pretty strong, they said basically they do not want the Federal Denr guys stepping in<br /><br />2 - contact the state fishery commission. OMG, I thought this was ancient history!!!<br /><br />Well Nate, everything is just fine with these properties.<br /><br />No more fighting City Hall, no more flooding in my basement, and I haven't been arrested for anything since! (Thats a good thing!!)<br /><br />The properties are in the process of overgrowing everything in sight, but it will take generations before they resemble what they looked like before this disaster began!<br /><br />Thanks for asking for an update, and I don't wish this upon anyone. What a nightmare it was!
