Darren you are in California. Ebay sellers are not exempted form California retail/seller laws. Ebay is in California, too. Their policies adhere to Californias consumer protection laws.<br /><br />Did you by any chance pay with a credit card via PayPal? If so, pack it up and send it back with a tracking number. Write your credit card company a quick note disputing your purchase of faulty merchandise, include the tracking notice, and I guarantee you will receive a full refund. Even is the seller said as is and had some other info like runs great, or even just runs you can have the charges reversed. You have 60-days to dispute the purchase. This is a federal law.<br /><br />NEVER attempt to reverse a credit card payment thru PayPal, tho they are going to want to handle the dispute and will send you email saying so. Ignore it! PayPal recently settled a class-action lawsuit over their practice of refunding your money as required by federal law, then taking their handling fee percentage out of that refund when it was collected from PayPal. PayPal claims to be exempted from the fed law; the suit settle out of court so no precedence was set. Also, it is possible during the time you are trying to deal with PayPal the 60-day clock may run out on your right to challenge the purchase with your credit card company.<br /><br />If you paid with an atm card, check with the cards sponsor. Many of them have a free benefit that warranties anything you buy for a limited time; often 30-days or 60-days. They usually exempt consumable stuff or stuff with a published life
like batteries. If your atm card is a visa, you are in luck. Visa was pressured into expending many of the same benefits for challenging cc purchases to their atm cards. Some other sponsors followed suit. Again, check with your cards sponsor.
