Some of you guys are missing the fact that it is no longer Diesels boat. The recovered boat belongs to the insurance carrier. Diesel has already been well compensated for the stolen boat and signed over his title to the carrier. Now it is the carriers issue to do with the boat as they please and Diesels issue to do with the monetary settlement as he pleases. This is a win win situation for everyone involved including the police. If any of you are looking to buy a boat of this type I would be contacting this insurance carrier. You can bet they will accept a very discounted offer. You only have to offer more than the local auction yard, consignment shop, wholesaler etc. whomever this carrier uses to sell recovered merchandise.

P.S. notice my forum name :)

Re: My Boat Was Recovered Last Night.....Thieves Busted

A local tow truck company owner got caught staling cars in Manatee County recently too.

The cops are saying they believe he has been doing it for a while.

It's pretty crazy down here in FL right now. Actually its been that was for a long time. This is nothing compared to what else had been going on.

Kidnappings, armed robberies, sexual predators everywhere, gangs, drugs, home invasions, etc, etc. I think the cops are more interested in the drugs than anything else. Those are the ones I see get the highest bonds and highest sentences.

I love looking at all of the public information available to the public down here. You get to see peoples police reports, sentences, and plea deals. You can look up your neighbors and see if they really are as good of people as you think they are.

These guys were stealing people boats. Boats that to those people were theyre means of escape from real life, and theyre means to go out and have fun after a hard weeks work. Especially in this econemy not too many people can go right out and buy another boat after some scum bag steals it. So theyre taking away someones fun, someones way of relaxing. Its pitiful. They should have gave these guys 200K bonds.

And they should be charged with dealing in stolen property. I dont get it. If you steal something then pawn it you get charged with dealing in stolen property. (and defrauding a pawn broker) but still obviously these guys were selling the boats so thats what they should be charged with. Dealing in stolen property is a 2nd degree felony which is a 10 year max charge. The charges they have now are 3rd degree which is a 5 year max charge.

They should also have the more severe grand theft charges. The OP's boat was almost a 100K boat. Yet the charges these guys got were grand theft $300-$20K. Theres other grand thefts which I believe are 2nd degree and is 50K-200K. (I think).

Maybe when the state picks up charges they will change it. Youll see on the pinellas county clerk site when it will say "information filed"> That means the state picked up charges and either they will remain the same or they will change them to the new charges. ALOT of cops always charge the wrong thing and the state has to straighten it out.

I can't remember if it was on this board or Wakeworld - but I remember a thread on how difficult this guy was to deal with. As they say, when there is smoke there is fire. Chalk one up for the good guys.

The detectives are still working on more charges. It looks like the current charges are still just the tip of the iceburg, they called me today asking for more information, I don't doubt the severity of the charges will increase. I'd still like to see just how much actual time they get though, it sounds like probably 5yrs max and probably will only serve 2 with good behavior, then back to business as usual.

Its a real shame when the police do so much work and we (taxpayers) pay so much money for that work, only to have a judge sentence them to something ridiculously short.

I wouldn't be surprised if more arrests aren't pending as well, what about the guy in the video that actually hooked up my boat? The shipping yard, etc etc. More people had to be involved to get a stolen boat all the way to Australia.

I saw where you was looking to buy a boat from them... Then found something else.. When they called to try and make a sale, you told them you bought a different boat and what u had.. Then a few months later the same turds came and took it... that is messed up.... Glad everything turned out okay in the end... The shame is how long these fart smellers have been ripping off folks..

All third degree felonies are a 5 year max. What that usually means is that if you've never been in trouble before you'll get probation. If you have been in trouble before or if you violate your probation you end up gettin 6 months to a year.

The detectives can only add charges if they find additional crimes to charge them with like if they find more boats they stole or more people they ripped off. Or if one of them snitches on the other.

The only way they're current charges will get more severe is when the state attorney files the information against them. For instance if they up they add a dealing in stolen property they will do it when they file information.

But right now grand theft is one of the least felonies one can get. I forget exactly but I think it's 16 points. 42 points is what one needs to get prison time. (usually time under one year is county jail and over a year is state prison.)

And unless your a career criminal you get a downward departure which takes 28 points off.

Basically if the charges stay the same these guys will get next to nothing.

Just keep watching the clerk site. You can go to the court house and see the information when it's filled. Or any other paperwork.

What if some of the boats taken off the lot turn out to be stolen?

Might only be 5 year max sentence, but what if there is count 2, count 3, count 4, etc. Can't a judge stack them up and sentence several in consecutive?
In other words, 10 counts of grand theft each carrying max 5 years = 50 years maximum.

???

Yea but it's slim to none they'll run them consecutive.

Someone said this guy had been charged with fraud before. If that's the case he's already a felon. If more boats turn up to be stolen then those are additional felonies.

Well have to wait and see but if it stays the same as now or even if he picks up one or two more grand thefts 300-20K then I don't see them getting much.

The dealing in stolen propery and or maybe a trafficking in stolen property will put em away.

Great News, to get your boat back. I am a little old school, so condolences on not being able to have a private, friendly chat behind the woodshed with them before the cops grabbed them.

it feels good just to read this and know that this kind of behavior, this kind of abuse of your neighbors, community members and fellow living creatures.. that there is a negative consequence for the offenders. in other words, ^#^&@#$ you boat thieves.

Re: My Boat Was Recovered Last Night.....Thieves Busted

Just have difficulty imagining someone putting their own business in jeopardy by stealing anything, much less grand theft and fraud.

Not me... people get greedy and probably do something one time and get away with it, and then just keep doing it. There was a jewelry shop owner up in Albany, NY that got arrested for fraud who had been ripping people off for years... even his family and friends. He would have elderly people bring in their rings to be cleaned or something, and he'd swap out the stones with fake ones on them. He did it for many years. My wife had bought several things from him and was recommended to him by a close friend that had known him for years and worked their part time. Thankfully, her stuff was all real. Other jewelers in the area offered free inspections/appraisals after it happened to help people figure out if they'd been ripped off. There are some people that are just evil.

All this talk of charges and jail time makes me want to bring this up. Because they are shipping these boats to oz these are federal charges. They may face more time than what they would under Florida law. I'm no expert on law so maybe not. Just a thought.
