Great news!<br />Anyway of getting some pictures of all this especially the tearing down of the houses and post them? That would be something to see half built and finished (NEW) houses being torn down. :eek:

Good morning all,<br /><br />Heres whats happening...<br /><br />Yesterday, June 11, the County District Attorney handed down a 216 count indictment against the contractor for illegal building in the County and is to stand trail in August.<br /><br />Nothing more pleases me then to see this jerk get his due.<br /><br />The District Attorney also handed down 2 indictments against the Town for excepting a bribe and failure to get the required Enviromental Impact Study done.<br /><br />I think the Town is getting off light, but at least something is being done.<br /><br />As far as getting pictures of the homes being destroyed, I was at work when all of this happened, so I was not there to take pictures of the actual destruction, and all of the debris was hauled away before I got home.<br /><br />I will check with the nieghbors to see if any of them got any photo's.<br /><br />Plus I'm being very careful as to what I do near these properties, so that I don't get caught in anyones trap.<br /><br />I want to put this thing behind me and get on with my life.<br /><br />One last thing, the County is looking into aquiring this property and preserving it as a wildlife refuge.<br /><br />So, that is where everything stands at this time, and I hope no one ever has to go through what I went through.<br /><br />Oh, by the way, I still have to go to court on June 19, for the erection of an illegal sign.<br /><br />I'll keep everone posted about that too.<br /><br />Kenny

Kenny, congrats, man! Been following the thread whole time but didn't want to chime in cause all I had was bad news - glad it ended well for you. <br />My experience was with the school district - build a new elementary school across the road (and up hill) from my church. Hit 3 springs in the process. Guess where the water went?<br /><br />We had a ditch (sort of) that was dry - only held water in spring when we had an inch or 2 of rain in the week. Now the ditch was full and overflowing across my flat yard 24/7 - in middle of draught.<br /><br />Complained and finally school board agreed that if I put a pipe in to divert the water, they would reimburse. Was a gentleman's agreement that they would okay at the next meeting (5 of the 7 members there at the site when the came to look).<br /><br />Well, to make a long story short - paid $3500 to put in 150 foot of 24" plastic pipe. At school board meeting they declined to pay and turned matter over to Army Corp who proceeded to issue a Cease and Desist order to THE CHURCH for confining a water way!<br /><br />This was 3 years ago - still not settled, and from the looks of things, will not be for a while - if ever. Want to build again (have 40 acres there) and cannot because we need a wetlands deliniation done (stream and some marsh land in the bottom of the lot) and Army Corp will not do that till the previous case is settled!<br /><br />So, you are fortunate and I am so happy for you! Again, Congrats!

Hi aspeck,<br /><br />Did the water enter your home?<br /><br />If water did not enter your home and cause damage, then this is why it is still in litigation.<br /><br />It's a good thing if the water did not damage your home, but at the same time, it is a bad thing, because you don't have any property damage (as in your home).<br /><br />Nothing was done here until the water started to damage homes.<br /><br />After 7 years of drought here, streams and eustuaries that had been dry are now overflowing due to an extremely wet spring here in the northeastern U.S. (Have had 6 inches of rain here during the month of June already and the month is only half over.)<br /><br />Alot of new homes that have been built around here are now under water, and in one instance, the homeowner has had to abandon his home due to structual damage caused by water.<br /><br />This home was built by the same contractor that I had all the problems with.<br /><br />Good luck with your water problems over there.<br /><br />Kenny

You are probably right Kenny - no damage to any buildings, no basement in the "Multi-purpose building" that the water now (or did before the pipe was installed) runs within 15 feet of, and during rains comes to the top of the footer. :eek: <br /><br />So, that is the good/bad news of it. Still is a shame that people are not concerned about their neighbors and you have to go to great lengths to get things resolved. :( <br /><br />Another thing that hinders us is because I am fighting for a Church I am stuck in between fighting for our rights and "turning the other cheek." It is not a very fun place to be, but we will keep after it! Your story gives hope! Thanks for sharing it with all of us and again, congrats! I am so happy for you! :)

Hi all,<br /><br />Now that the properties next to me are in the process of being returned to their natural state, I will only be updating this thread on a weekly basis.<br /><br />Not much to report this week other than the original grade has been restored.<br /><br />Had some T-storms pass thru over the weekend and no flooding could be found.<br /><br />I guess we shall see the next time we get an inch or more.<br /><br />I have to go to court on Thursday, for the "Illegal Sign" that the Town claims I erected.<br /><br />I will update that after it happens.<br /><br />Other than that, the past weekend has been qiet, and I finally had a chance to go out on the boat and relax at the beach.<br /><br />Flynn's was wonderful.<br /><br />Kenny

Hi mellow,<br /><br />The sign read: "IF YOU WANT TO KNOW ABOUT THE TRUTH ABOUT THESE NEW HOMES, INQUIRE HERE".<br /><br />As far as the basement is concerned, I only have a few small puddles of water left.<br /><br />If the rains would give the northeast a break, I think all of the water will be gone in 3 - 4 days.<br /><br />Kenny

Incredible mess and success... congrats. on your patience and persistance.<br />I can't help but notice, after you said you were locked and loaded, things started to happen for you. I wonder if someone on your council or maybe another resident is an iboats forum reader?<br />Nice work :)

Thanks Magster,<br /><br />I became POed at that point in time and wasn't backin down from nothin.<br /><br />I think the Town really thought that I was going to go "Postal" on them, which if the Town wasn't willing to do somethin, I may have.<br /><br />I don't know if anyone on the Town Board is an iboats.com member, but if there are, well then they now know how the residents of the Town feel about their greed and vagrant disregard for the ordinances that they write. <br /><br />Kenny

Hi all,<br /><br />Well, went to court yesterday and the Town won this one.<br /><br />I was found guilty of erecting a sign without the proper permits.<br /><br />Had to pay a fine of $25 and a surcharge of $50.<br /><br />What a joke, even the Judge asked the Town why I was charged and jailed for this.<br /><br />Of coarse the Town had come up with some lame brained excuse, how I was engaging in harassment against a building contractor.<br /><br />I explained the whole this about the contractor to the Judge, who agreed with me but according to the Town Ordanance that regulates signage, it is illegal to post any kind of sign in the Town without a permit, so I would have to pay the fine.<br /><br />This ordanance also means that you cannot even put a "For Sale" sign on your car if you want to sell it, unless you have a permit.<br /><br />The Judge told the Town laywer that the Town had better find validity for this law, because it is the only law that regulates the posting of signs like it anywhere in the country.<br /><br />The Judge also advised the Town, that every canidate for the Town Board election this year had better have a permit to post their election posters, which have already started to appear, and that each politician will need a permit for each and every poster posted.<br /><br />Other than that, the basement has dried up and it is still raining here.<br /><br />No further water infiltration into my basement.<br /><br />The property has been returned to its original grade and 4 very large maple trees have been planted on the southern end of property and they are suppose to plant more.<br /><br />It was weird comming home from work the other day to find these trees planted because I was sort of getting use to seeing the property cleared.<br /><br />By the way, the county has aquired the property and has designated the property "Wetlands".<br /><br />Thats pretty much it for now, I'll keep you posted if anything else happens.<br /><br />Kenny

Hi all,<br /><br />Just an update...<br /><br />Well, the county has designated the property "wetlands" and has posted signs stating that the property is "wetlands".<br /><br />But yesterday, a Real Estate office here in town has placed "For Sale" signs on the property as 4 building lots!<br /><br />I don't understand how this has happened so I called Town Hall, and they stated that another construction company, which is owned by the same contractor that I had all the problems with, has applied to the Town for the construction of 4 new homes.<br /><br />I told them about what had transpired at this site, and they claimed that they had no knowledge of any previous problems, so I hung up the phone and called the County!<br /><br />The County just called me back to advise that if I see any further attempts from anyone to sell or build on this property, to call them, as the County is now the owner of said properties.<br /><br />It looks like another bag of worms has been opened, but at least I now have the County on my side.<br /><br />I guess I shall see what happens next.<br /><br />And the saga continues...<br /><br />Kenny
