Re: denied for firearm

Produceguy; How did this come out for you?
The below quote may be what kept you from getting that AR. When you attempted to purchase, the dealer ran a NICS check, right? Did you also fill out a release form for medical info? If so, that was a legal release for them to access ALL of your medical info, and they may have decided to make a decision on the side of caution.
It's also possible that somewhere else in the U.S., someone with a name just like yours has some legal issues that would deny them a firearm. The NICS is notorius for just such instances, and the legal purchaser is left up to the task of proving he/she is not the other guy.

Here in Iowa, one can go to the local Sheriff's office and apply for a purchase permit. They do the background check, and if one is clean, they get a paper purchase permit good for a year. One can also get a concealed weapons permit, good for five years, and in both cases, one can walk into a store and walk out with whatever they wish to get, no NICS check done.

I don't know if Arizona has such a system in place, but it might be worth checking out.

Roger
I'll look into that but now since denied I do think that info triklls down to the PD so they are aware of it.
No, I didn't sign any medical release forms. I kinda thought the FBI would just kind of know if they did a full background check.
As far as were I'm at, I went and got my prints done and will send that and some other info off on Monday.

I hope just the prints will clear it up. Maybe they are just matching me with someone else..... Thanks for the info

Re: denied for firearm

I want to return to your denial of purchase.

Okay it was for an AR-15......... from where? I think this is somewhat important as I had mentioned once before....... numbers could have been transcribed, sloppy, letters in your name could have been mixed up. I sincerely think if there is nothing in your background, then you should be okay.

Here is a link to the purchase form http://www.atf.gov/forms/download/atf-f-4473-1.pdf on the explanation pages it gives some descriptions of the questions.

Here is the FBI page http://www.fbi.gov/about-us/cjis/nics/nics

Just as a side note........ you are permitted to purchase a black powder weapon.

Re: denied for firearm

I was going to suggest it was because of poor spelling.

I wonder if he still has the application so I can look at it. I was going to try to fill out another one but I don't want it to look like I'm just trying to buy up all kinds of guns. I'll call him Mon.

Thanks guys

Re: denied for firearm

There's been a lot of talk about the federal check but there's also a state check here in VA. Most of the time we pass the federal check immediatly but the state is overworked and understaffed so they will put you on hold for several days sometimes.

I have a CCP and since I got it it seems like it takes me longer to purchase. They put me on hold EVERY time and it's always on the state check not the federal.

So back around Christmas I decided to quit carrying my holstered LC9 when I'm riding the Harley and get a 380 LCP for pocket carry. My daughter decided to buy herself a 380 also so we went to Gander Mountain for the big sale. She walked out with her handgun 45 minutes later and it took me 4 days. She was a first time firearm purchaser and I have a carry permit????

And for the record, I'm a huge bowhunting fanatic. I even make homemade bows. But I deer hunt the late season with a Panther Arms AP4. Thats a 308 in the AR 15 platform. In VA you can't hunt with the 223 cal AR 15. My 308 shoots like a bb gun and is deadly accurate even for a guy who shoots way more bows than guns.

Re: denied for firearm

I had my identity stolen and when it comes to gun checks it usually took a day for it to get sorted out. It always annoyed me so I went and spent the time to get a carry permit. In my state if you have a carry permit you just present it, fill out the paperwork and leave; no check before you go.

The first time I was denied I called and asked why and was told the reason. I started the investigation and clearing process of my records at that point but it took time.

There is a lot of press on guns just now and I am sure gun laws could be changing.

The AR is an awesome rifle and you will find yourself enjoying it on the range.

My entire family shoots from my 3 year old to my wife and going as a family to shot is one of our favorite things to do.

Re: denied for firearm

Update. I went back to the gun shop and asked if maybe I misspelled something on the app. The owner said it doesnt work like that. As soon as the feds have your social all your info comes up so spelling shouldnt be an issue.

I sent all the info off and now its just a waiting game but in the meantime I did get to take my 7 year old son shooting. I do have a walther p-22 and he shot it for the first time. I dont know who was more nervous, him or me. It was really cool.
lanc
I dont know if its against any rules on iboats but maybe we can post pics of our rifles or guns or grenades, lol

Re: denied for firearm

First off there's no such thing as an "assault rifle" a rifle is a rifle no matter the make or model. The assault part is the intent of the person wielding the rifle.
Second, the AR-15 is a great hunting rifle, with the proper bullet. A 62gr soft point that I handload will drop a deer in it's tracks, I've dropped several, and my AR is my go-to rifle fro stalking hogs.
Last back to the OP. I have been a firearms salesman for the past 18yrs. When your NICS check came back denied, the dealer should have given you a handout on how to appeal the decision. There is no phone call, no web site, you have to do it in writing. Go back to the dealer and ask for the handout, the dealer will also put your NICS transaction number on the handout for reference. That transaction number needs to be on all correspondence.
As far as why you were turned down??? Any DUIs? some states give you the first one free, the second or third is a felony. DUI with injury, Misdemeanor Domestic violence, domestic battery?? Stalking?? Ever had a restraining order taken out on you???
Arizona is a shall issue state for CWP(Concealed Weapons Permit). If you apply, follow their training protocols(varies by state), and pass the background checks, they have to issue you a CWP. The checks are usually done either by the sheriffs office, or whatever State police agency handles it(again, varies by state). They will check you locally, statewide, and nationwide. In most states after you receive your CWP, when you want to purchase firearms, your CWP will supersede the NICS check, instant approval(also varies by state).

Yes, He gave me a ntn number with a sheet that shows how to appeal. He told me to call and see if they would tell me anything wich by law they cant, I know that now.

No buddy, no dui's,no nuthin.

Why is it that in some states you can't hunt with certain rounds? I have heard this before and also heard you cant hunt with a large capacity mag.

Every state is different. In SC we don't have the high cap. mag issue, some states limit you to a 5rd mag in a rifle. As far as the bullets are concerned, in SC you can't hunt with any military or hard jacketed bullet. That's because the bullet will just zip through the deer/hog, leave a little hole with little to no blood trail, and that critter will probably run a mile and you will never find it.

Re: denied for firearm

Interesting thread.... Very interested to find out what held up the sale.

Couple of comments

The multiplying gun comment is very true............. That's why i got rid of all of them!

AR-15 is an excellent "close range" hunting rifle. Many different rounds and barrel types available make it so.

A hand gun is what you use to fight your way back to where you keep your AR-15.

You wouldn't want to be in a shoot out with a guy that has an AR-15 if all you have is a hand gun or a shot gun!

Just sayin :D

Well, as an option, they do make rim fire AR's :)

Ill add that to the list of reasons not to live in Illonois. LOL  Too cold being the first!

The places with the toughest laws seem to have the most gun crime, funny how that works.

Interesting. Because in WI, you must use centerfire rounds (I believe there is some shotgun only in some southern counties. I don't have the rules handy.)and not rim fire unless you're hunting squirrels/rabbits etc.... I suppose because of the wide open space of IL it's probably shotguns and black powder for deer etc....

Sounds backwards - I thought that rimfire was not allowed for much any more

You can use centerfire revolvers and single shot pistols .30 and larger for deer. Honestly there's not too many places around here where you'd be looking at a 200+ yard shot that's not a cornfield...
